Absolutely agree with you that is better to have lbs than ounces of information :) and still...you many need to get a suitcase.

"Well, cherr if all the waivers were like yours there would be no need to worry. People would just take an ideal 6-8 months time line for reference and the sit back and relax. Now there are nationalities that have a high degree of visa fraud these applicants are scrutinized more than others. IOs come from all around the world but its the fraud pattern that exposes some nationalities to more checks than others"

Well, I am not sure how is my waiver comparing with others  ...we are all divorced  . Yeah I stayed married more time, probably because I gave more shots to try to fix it , had more patience (which I really do not have) or I don't know, waiting for a sign from the clouds that says "MOVE ONNN"? I was looking an ideal 3 months max!!! hehehehe

Yeah the nationality factor...could be/could be not...don't know, haven't read something that might looks like that case. I think that can matter way more in AOS than in this step.

Point aside, does not matter how much evidence you have brought during AOS (if you went through that one)...I-751 is a new brand concept for evidence.

If you find those Xtmas postcards, envelopes with both your names on it? I included ALL that and I will still keep it until I get my citizenship...IF everything goes right in this last one. Important tip: MAKE A COPY of everything. You never know when you need to refile everything because they want the same evidence again.

Btw 3600rs, oh sorry on the geography  ...I used to be better though, I think we forgot our Australian friends... :P

I will keep you posted...so bad I can't drink Baileys with my coff at work! And please Sara keep us posted.

i have 2 other problems

1--- there is no change in my online status at all since i filed my I 751 waiver. its the same message 'Case received n Pending'

2--- i filed my waiver through a lawyer n i think that was the biggest mistake i made. he is an indian lawyer who is interested only in collecting money. he has no interest at all if i stay here r not. he asked me 2 pay him $3250.00 for my waiver. i already paid him $2000.00. but beleive me he proved 2 b only a very expensive mailman 4 me nothin else. he mailed my petition n receiving my notices from immigration. i want this tension 2 b over soon n he talks about taking my case 2 the immigration court coz then he 'll charge me more money. thats y i sent my RFE myself without him. i don't no how 2 get rid of him. pls advice me on this issue as well.

thanks to u all

Let me address your problems the best way I can.

Its normal for any pending application to show "case received and pending" No need to worry.

Yes, your paying him not for filling the forms, but for the years of experience about how to present the case in the best possible manner in front of the CIS, and his experience at the local CIS office. And lawyers can be expensive. My AOS lawyer was so friendly with my IOs in my local office, that I was already feeling like I am approved before entering the interview room.

There is nothing to say that an Indian lawyer is a bad lawyer. Actually he knows better about how to handle South Asian cases and understand better the local marriage customs and the circumstances surrounding the marriage.

He cant take your case to immigration court, its the CIS who takes people to immigration court after a denial. The lawyer will defend you in immigration court if you hire his services.

As per your lawyer contract you can fire him anytime by breaking it, you may lose the money, but then your free to hire someone else. I think the best for you is to wait till your case is finalized.

yes u r right i think i should wait for some time. but plsss pray for me. i'll keep u informed about my case. thanks for ur sincere advice.

did you have a written contract about how he will handle your case? Or if he will be there if you ever gets called for an interview? Some lawyers charge lesser than that and do their homework..The lawyer would have received a copy of your RFE and informed you, did he? I suggest you inform him that you sent the RFE to prevent any confusions later. And yeah, case online don't change everytime and it's pretty normal to see that message there. And you probably hired a bad lawyer but you know be careful next time. best of luck!

yes he received my RFE and informed me. but i insisted to sent my RFE myself to immigration. coz i don't no how he sent my original petition. i gave him all the papers with petition fee and he sent papers without even bothering to show me the final packet that how he presented my case b4 immigration. i don't even know that which papers he sent n which he held back. there should b a trust b/w a lawyer and a client and i m lacking this. i signed a contract but he didn't gave me a copy. also i have very little contact with him coz he is at a distance of almost one hour freeway drive from me. now i m praying that O' God help me and get me approved at this stage coz i don't wanna proceed with my lawyer any more. i want all of u to pray for me.

I took a few weeks before I got a response after mailing in my RFE evidence. My online status never changed, but I was approved and received the congrats letter from USCIS. I received the physical greencard yesterday but still no change to my online status. I wouldn't worry about it.
