Last name issue, please help.

Timeline

Hi, my wife took my last name after the marriage, but her passport has her maiden name in it. Does that present an issue at the interview? As far as I know, visas are given with the same last name as the one on the passport. Also, how will this affect the info on the Green Card? Will the GC have her legal last name or her maiden one? Please give me some advice. Thank you in advance.

It shouldn't....in all my papers I go by my married last name, but all my documents have my maiden name. That's why on the all the forms you fill out they ask for any other names you used. I don't think it's a problem! Lots of people wait to change all their info.

If u want to feel better ask ur wife to get the New passport with Ur Last name on it.

It shouldn't be a problem, just make sure you list the married name and maiden names on forms when asked for other names used.

Hello all,

Do you know if my wife needs to add my name under " Spouse Name" in her visa? She got the passport before our marriage.

ROC Journey

Sent I-751 : 4/5/11 (USPS Next Day)

Package received : delivered at 11:55 am on April 06, 2011 signed for by D RENAUD.

(check cashed on 4/12/11)

NOA :Received 4/13/11 (date 4/7/11)

Biometrics: 6/6/11 (date on letter was 5/9/11)

NOA: 10/18/11 - Received letter stating I-751 APPROVED

10/25/11 - Received 10 year GC.

If your wife has taken your name at the time of the marriage, she should go about having that last name reflected on her IDs (including passport) in her home country. This is mostly for the sake of simplicity, not because it is specifically mandated in the rules for obtaining the visa. Going by your timeline, you've recently received your NOA1 for your I-130, so you do have a couple of months at least before it is approved and another little bit before your wife is ready to interview for her visa....I would think its enough time for her to get new identity cards reflecting her new last name.

If u want to feel better ask ur wife to get the New passport with Ur Last name on it.

These problems are best dealt with by changing documents when changing names. Your wife would get a new passport bearing HER current legal name.

Facts are cheap...knowing how to use them is precious...
