I want to start off by saying thanks to everyone here who posts they journey good and bad. At the very least we all know we are not alone on this journey.

My question I thought was simple but as it turns out maybe not so simple. My wife to be is from Colombia and she has had a Tourist visa for 10 plus years now. We really want to get married and start our new lives togther ASAP. I was naive and just assumed that if we married here in the states and then quickly applied for green card she could stay here with me. But From what I am reading that might not be the case. I very much DO NOT want to complicate any applications process and very much want her here with me ASAP. One more note she has two young children which we obviously also want to bring to the states.

What should I do K1 or K3?

If we go with K1 what happens to her tourist visa during the processing time?

Do we marry here in the states and then just file for K3?

If we go K3 will she have to return back home during the processing?

which way is faster?

I filed for my husband's k-1 while he was in the U.S on an h2b visa, we didnt have any conflicts, i dont know about tourist visas but im assuming that there wouldnt be any conflicts, but dont quote me on that. I think that the K-1 is faster, from all the '#######' sorry for those that did the k3s, i just think that k1 is less complicated and faster, bota bing bota boom, were doing AOS now, so, its all up to you. good luck.

March 10, 2009 AOS paperwork sent, will wait for it to arrive via tracking #

March 12, 2009 AOS paperwork arrives in Chicago

March 23, 2009 NOA1 for I-485, I-131, I-765

March 30, 2009-Biometrics letter received, appt date April 10th @11am philly office

April 10, 2009-Biometrics appt. done, in and out in 15 minutes

Nov. 18, 2009-Card production ordered

Neither her or her children are in the USA right now. All three have tourist visas. She came to the US to visit family with full intentiuons of returning home like she did. And no we have not gotten married yet. That is why I am confused should we get married then file for a K3 or should we file now for a K1.

Marry when and where you wish. K1 is to bring the fiance to the USA to marry and stay. (K2 for children). CR1 and CR2 would be a far better choice for bringing a spouse and children than K3/K4 would be. Make your life decisions and then follow the guides to begin the visa process that best fits those decisions. We'll be here to help with remaining questions.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)
