I have file two separate petition I-130 for my wife and my child(baby).Her petition is approved but for him uscis send me e-mail ..we mailed a notice requesting additional evidence or information in this case I130 IMMIGRANT PETITION FOR RELATIVE...My question is when her petition is approved NVC will Assigns Case Number just for her or they will wait when both petitions are approved?And one more thing.Do I have to send for each petition separate for him and for her DS-3032 and DS-230 also I-864 Package(Affidavit Of Support)? Please answer my entire question because I’m very confusing these situations that two petitions are not same time approved.Thank you so much advance! GOOD LUCK!

You said it yourself - you filed separate petitions. Each petition will have its own case number and everything else will be separate.

For your baby, why didn't you just do the consular report of birth abroad and gotten your child a US passport, I presume you're the USC?

We need more details to answer properly.

If you are a US Citizen, then your child needs to have a "Consular Report of Birth Abroad" filled out and submitted with the proper supporting documentation so that your son can get a US Pasport. NO PETITION OR IMMIGRATION VISA REQUIRED FOR THE CHILD!

Yes your wife will proceed independently of your child, however, if they both land at NVC together, the AOS fee of $70 only needs to be paid once for both of them. (Again this may not be necesary if your child can get a US Passport today).

Assuming you still think you need to go thru the immigration visa process for your child (why?) then Yes, you will need to fill out a separte CR-1 and I-1864 for the child, and pay the separate fees.

They will not wait for the child to assign a number to your wife, got it?

Yes, DS-3032 for each.

Yes, DS-230 for each (I think?? I may be wrong here.....on this one)

Yes, I-864 for each.

Our case is similar to you only it is my step-daughter who is the daugher of a US Citizen so I will stop her petition as soon as I can get her US Passport issued by the Embassy.

Like Milimelo says if the child is your why did you go to the consular where your wife country and report that is your child, you should get your child US passport and the child is US Citizen if the case got aproval, than after all the child can go anytime, because now your child is US Citizen. This is not very long process than you have go through a I-130 stuff.... Hope this will help you out a little bit.

Okay, that is your story, i guess you have to go with the long way then, you have to file 2 separate file on I-130 (1 for your wife and 1 for you child). Remember to included G-325A for your wife and your son. Hope everything go well for you.

You can also file a I-864W which NVC advised me to do since I am a born US Citizen and my son was born in India. But it is 100% better to report the birth to the local consulate and get a US passport made. It makes everything much smoother.
