Uh oh... was thinking - does my fiancee have to have a Social Security Number in the US before we can get married???

I believe it does vary from state to state. We were married in North Carolina and it is required. However, since I am Canadian and do not have a SSN the clerk's office had a standard affidavit that I signed and they notarized indicating that I was a non-resident and as such did not have a SSN. Problem solved! You should be able to find out from the office where you obtain your marriage license. Good luck.

A non american citizen cannot get a SSN , a fiancee of an american citizen does not make an american citizen . But marriage to an american citizen makes for an american citizen , ( a K-1 visa holder is an american citizen based upon the marriage of that american citizen ). Which means to apply for a SSN you must be married to the petitioner with a still valid k-1 visa within the 90 days . Maybe people should read the document for obtaining an SSN from SSA on visajourney or USCIS website .

I'm sure every State has some way around it? I mean, what if Tourists want to get married at a US destination?

I wonder about Jersey...that's where we are planning for :innocent:

I know New York doesn't...if you are close enough you could get married there instead.

Yes. it is required in NJ. In addition, I believe there is a waiting period.

Wow if this is the case, I'm so glad we got married in New York as I JUST got my SSN card like 2 weeks ago!!!! I've been here 8 months!!!!

Just to clarify. In NJ a SSN is only required for the US citizen, so the Canadian fiance would most likely just have to show the other required identification. They also require a witness to get the license. Add in a 72 hour waiting period and I guess NJ isn't the place to go for a quickie wedding. That's why we ended up in North Carolina

I got married in NJ without an SSN, and it was no problem. Instead of my SSN I just needed to show my passport information. The waiting period was a matter of days (maybe 36 hours after we got the licence). I arrived in the U.S. July 17 on a K1 and got married August 1. My SSN came in early September.

My fiance at the time called the city to clarify, so maybe your fiance could call the municipality in which you want to marry just to confirm and put your mind at rest.

The lady who helped us when we got out marriage license put my Canadian SIN in the SSN line. What a dummy.

Classic. It's so funny dating and now being engaged to a Canadian. I'm SO amazed at how self-centered and unaware some Americans are that things are different. So much is assumed at times! Sheesh! :bonk:

(LOL... I've been DYING to try to find a post where I could use the "bonk"!)

Last i heard Michigan does not require it but that was a few years back.

HMMMMMM so do explain how 10 days after I entered the US on a K1 visa I walked into our local SS office and ten minutes later came back out SSN ordered. It arrived 5 days later.......

When we applied for the marriage license the lady at the desk just used my passport number as at that time I didnt have my SSN.

It's amazing the number of people that think that marrying an American citizen makes you an American citizen. Americans, Canadians and Bermudians have been accusing me of being American since I married Phil.

It seems to be a very prevalent myth.

Also, of course non-US citizens can get an SSN. As an example, anyone with a green card can get an SSN.

My guess the reason why they're saying that is... once upon a time it used to be that way. Citizenship was almost an automatic when marrying a USC. I remember learning that exact thing when I was in 8th Grade in my Civics Class and we were learning about citizenship as related to US Laws, voting, etc. Mind you... that was quite a long while ago. Ahhh, to be that young again!
