Hi all, ok this is a confusing mess.

I am wanting to sponsor my fiance, i have 3 kids, but i allowed my mother to claim all of them on last tax return as i did not earn enough to file. I figured i would have to file 2 I-134, one for me and one for my mom as a cosponsor because either way my income would not be enough(i plan to be working before we file). I have no ideal what household size to put on each of the forms.

My kids are actually with me, so would i put on one form...Me,my fiance, my three kids for a total of 5...

On the other, my mom's would i put...MY mom, my fiance, me, my 3 kids totalling 6?

I am confused what household size to put on each..

the sponsor in your case will have to include you, your fiance, and your children in the household size.

If you are the sponsor then the number is 5 (you+fiance+three kids). If your mom is the sponsor she would include herself in the household count making it 6.

Are there any other people in your mom's household? They would be included as well.

Do i feel out 2 separate forms, one for me and one for my mom, because i am the sponsor.yes, but, i do not meet the income requirements? that is what i was asking.

should i feel out one form with me, my fiance, my 3 kids, and another, with my mom, my fiance, my 3 kids..what do i put on each form?

you are always a sponsor. if needed you can submit additional/supplemental/co-sponsors. you fill out one form regardless.

Thanks greatly pushbrk, but i am still wondering about whether i fill out 1 or 2 I-134's...Is it 1 for me as the petitioner with me, my fiance and my 3 kids...and ANOTHER for just my mom, and my fiance. I put fiance on both forms? Thanks alot

If mom claims the kids on her taxes as the OP indicated then the children would count in her household. I didn't proof read my post to catch that I included the OP in mom's count. Sorry for the confusion.

The key for who gets the kids in their household count for the Affidavit is what the most recent tax return shows. If the OP claims the kids for 2008 then mom would not have them in her household count. But if they are on mom's taxes then she will have to include them on her affidavit.

From the I-864 instructions:

Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored..

OP would submit Affidavit regardless of income as they are submitting the 129F petition. Mom would submit her Affidavit as well if OP's income is not sufficient.
