History: Married 8-07, She arrived Seattle, WA USA 7-08

I want the 10 yr green card, not 2 yr if possible. So...

I want to file AOS in June, is that right?

If so, then tax timing is an issue...

I'll need to be sure the USCIS gives her an EAD, then Soc. Sec. # before 10-15-09 so I can file taxes by the end of my extension. Will this timing work out?

If the current projected time frame for EAD of 3 months continues you should be ok but it will be tight - you might only have a couple of weeks leeway. If you apply the early part of June you will be in a better place to accomplish this than if you apply later. There is always the risk that the EAD will take more than 90 days to process.

She can get a SSN as soon as she has her EAD. She does not have to wait until she gets her greencard.

Take the EAD card, passport, and form (can fill in at the SSA office). They will enter it into their system and mail the card to you. Usually takes less than two weeks.

I just re-read your post, you can file your taxes now you dont need a extension, your wife cant get a SSN now as she has no right to work so you can file form W7 and get her a ITIN

Thanks! Yep, you're right. But from John's previous comment in another thread; I should get the 10 yr green card by waiting until after our 2 yr anniversary for the AOS aproval. Our 2 yr anniversary is 8-09 so I could file anytime now with the 7 month processing time. The new civil surgeon medical exam is only $125.

I'm here for K-3 too, i had my SSN before but i want to change my name and address i went to SS office, and the officer told me that i need to have my EAD before changing anything on my existing SSN, so i applied for my EAD last January 10 thru E-filed and i got my Biometrics done last Feb 11 so i'm waiting for my approvals soon, i want to file my AOS before our 2nd wedding anniversary also which is dec 21, 2009 to get the 10 years GC so probably around sept or august of 09, EAD processing time will be 3 months.
