Hello, there.

I know that interim EAD after 90days from RFE notice :(

But, I saw some people got it after 90days from NOA1 even though they had RFE.

Is it just up to the officer?

Since I had RFE, I want to know about it :P

Has anyone have the experience?

07/06/2006:Approved(I-765)my birthday!

07/08/2006:Touch(I-765)

07/10/2006:Touch(I-765)

07/11/2006:EAD card arrived

07/14/2006:Recieved interview letter 08/29/2006

08/29/2006:Approved(I-485)

09/12/2006:Recieved Green Card

I had a RFE early December, and went for the interim right before Christmas (Newark, NJ). But, every office is different, I guess. Good luck.

04-21-06 - AOS Interview

04-27-06 - Approval

05-17-06 - Green Card in hand

02-11-08 - File to remove conditions

03-15-08 - Biometrics

03-18-09 - Approved - No interview (Card production ordered)

03-24-09 - 10-year card arrives!

We gave it a shot after day 90, and got the interim. I didn't mention the RFE and the officer didn't either.

It seems they do not adhere to that statement on the RFE letter.
