Hi,

My wife (here on K-1) and I just returned from our 2nd trip to the California DMV office to try to get her a drivers permit.

The first trip, they said she needed to show her NOA that she is in the process of getting her AOS.

Today, we returned with the NOA that says the AOS application was recieved and is being processed, however, DMV says that she needs to have her AOS APPROVED (and/or recieves a new I-94 that doesn't expire in less than 30 days) before they can legally do anything (issue ID Card, permit).

Are they correct on this?

Does anyone have any experience with the California DMV while they were in-between K-1 and AOS?

Do other documents have any additional bearing on this (ie work authorization, travel document)?

This dead-spot of being in-between statuses really sucks!!!

What DMV did you go to?

When I took my husband to DMV, we were told that we had to wait for his EAD card/approval stamp to apply for ID/drivers license (our I-94 had already expired). If you are still within time frame of I-94, I'd try a different DMV office...they may approve your application.

10/23/08 - Card ordered: APPROVED! (USCIS website)

10/30/08 - 10 YR GREENCARD RECEIVED

K-1 and AOS

07/07/05 - K1 Packet received - USPS tracking

09/19/05 - K1 approval online

12/01/05 - 1st K1 interview in Kingston: need updated birth certificate

12/13/05 - 2nd K1 interview in Kingston: Approved!

05/01/06 - AOS/EAD packet received

08/09/06 - AOS interview in SF: APPROVED!

08/19/06 - 2 YR GREENCARD RECEIVED

What DMV did you go to?

Hi,

My DMV is in Colorado and they issued me with a DL once I showed them my NOA1 (AOS receipt) and my marriage license and also my passport showing my K1.

They did only issue it until the end of my K1, but it has worked out great for me since I have my interview only a few days after it expires and I think they give you a months grace once it expires anyway.

I think it really is hit or miss on whether they issue you one. And of course it differs state by state.

I'm pretty sure if you look of the Department of Revenue website they have details about it.

Hi. It must be so frustrated situation. We have been through same situation during the pending on I-485 from K1 visa in Los Angeles, CA. In the end, I had to wait till you recieved EAD card otherwise they didnt accept it. We tried to call DMV, went down to local offices and tried many things. I know it can be hard time but you have an option to take public transportations etc so hope your approval will come soon. Wishing you best!

just trying to confirm, the steps to getting SSN and DMV license in CA:

1. US entry

2. 2 weeks after, go to SSN office to apply for SSN.

3. upon receiving SSN card, go to DMV to apply for license, take written test, pass it then schedule driving test (do you have to get married first before applying for DMV license?) so, the driving test must be scheduled within the month of US entry... thus less than 60 days before the I-94 expires. i'm gonna try to do the math here, so we wait 2 weeks, plus 1 week to get SSN card (if nothing goes wrong, which is so very optimistic of me :D ) then another week to schedule driving test...it's almost impossible to do all that in a month! it would be really hard for my fiance to not drive for 3 months or more...it's almost a necessity here in LA... if we have to wait for his EAD to get his license.

also, what about car insurance? in CA don't you have to it before getting a license? or is it for car registration? i forget. the car is already insured but my fiance is not yet added of course...i think not until he gets SSN or driver's license ID. arghh...i can see why people opted for K3 instead. :hehe:

Visa bill mailed on 6/3

Visa bill received on 6/7

I-864 stuff was sent via overnight mail on 6/14!

Information packet and docs generated 6/20/05

I rec'd the DS-230 packet on 7/26

9/15/05 CASE COMPLETED!!!!!!!

10/6/05 Case sent to consulate

10/27/05 Medical Exam ...was marked incomplete

11/10/05 New Medical Exam letter issued! YAY!

11/15/05 Interview--APPROVED BABY!

4/30/06 Activated IR-1 Visa at the Pacific Hwy Crossing in Blaine, WA

5/12/06 Dave Received the Welcome to the US letter...

5/31 Green Card arrived in the mail! Also got 2 more welcome letters!

Dave's company has transferred him 7/6!

Started his position in Bay Area, CA on 8/14!

Just got my learner's permit from the DMV in CA but it's only valid till my I-94 expires.

What I did was this:

- Came in, got married, applied for SSN after 2 weeks of arriving

- Obtained SSN after a week of applying

- Went to DMV, sat for written test, obtained learner's permit

You need to schedule an appointment to take the driver's licence test (a must for anyone without a driving licence in the states). However, the licence (once successfully obtained) will only be valid for the duration of your I-94. Once you get your EAD, you will have to "renew" your licence again.

You do not need to wait for your AOS to be approved if you have your EAD.

I just went through the California DMV, and what you need is a Social Security Number. Any other document will be rejected without it. Once I had it, I presented my canadian passport, marriage certificate, and SSN. That's all they needed. Withouth the SSN you are out of luck in California. No exceptions....Sucks huh...
