Why would my case be delayed?

I've been waiting for NOA2 since NOA1 5/20/08 . I did a service request and got this letter

The status of this service request is:

The processing of your case has been delayed. A check of our records establishes that your case is not yet ready for decision, as the required investigation into your background remains open.

Until the background investigation is completed, we cannot move forward on your case. These background checks are required to be completed on all applicants who apply for the immigration benefit you are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete. If you do not receive a decision or other notice of action from us within 6 months of this letter, please contact us by calling our customer service number provided below.

I have a small drug possesion arrest ( 2year deffered adjudfication) from 20 years ago and there is no violence of any kind to this arrest. Traffic tickets are the only other record about me that they could find to investigate so what the hell is the problem ?

I've lived in the same state 3 different cities all my life so there is not much searching of my background to do

Any ideals ?

I would assume the background checks they are talking about are, in fact, Administrative/Additional/etc. Processing that can happen at any stage of the process - USCIS, NVC or USEM level. The only thing we know about it is that can be either random, or for a reason (lately it seems to have been happening at random a lot, but mostly at the NVC level) and that it does not have a fixed timeframe the officials could tell you about. The current NVC/AP cases seem to be hanging around there for 50-ish days.

Of course, all of this is just my (un)educated guess. Considering your background, they might have had a reason for additional background checks I honestly don't know anything about.

Interview Date: April 8th 2009, 10:30 - APPROVED!

K-1 Visa Received: April 9th 2009

POE: Aug 8th 2009, Minneapolis

Wedding: Aug 28th 2009

my k1 noa#1 is from 3/18/08, i have been waiting for a year now, i just got the same letter that you got on the mail yesterday, and it said the same thing. funny thing is that i have no criminal background check.

Rodney,

I don't know that anyone here knows exactly what background checks the FBI does or may do. I do believe they include "name checks" which may likely involve checks vs. various "bad guy" lists using your name. This may result in a hit and require more stuff to be done to see if you are one of the "bad guys". I know that my name was on a list, and i had problems in airports for a few years and this was admitted to me by an airline. I am worried that I could end up in the same situation, but who knows.

I would not hesitate to contact your Senator as well. Even with the above, 1 year is too long. Also it is worth noting the USCIS and FBI have publicly stated "All USCIS requests pending for six months or more as of February 28, 2009, have now been responded to by the FBI’s National Name Check Program (NNCP)." (see the news on the home page). This means yours should have responded to or will be very soon. Maybe call the USCIS and ask specifically "When was my case been submitted to the FBI NNCP?". If it was more than 6 months was there any response and what was it. Not that the USCIS will do what they should to respond to a constituent, but sometimes if you ask the *right* question.

Hope you get your NOA2 soon no matter what!

have some more patience, we have been waiting for 200 days and got approved, they sent us letter that we're still in background check and in the same time a letter for our noa2 by post office, so yours might be on way!!!

It's hard to say without a fact finding discussion into your case but commonly delays such as this one result from sharing a name with a criminal or you yourself being on some sort of watch list. It often takes a long time to rule out one John Smith being THE John Smith of concern. Another possibility is that a young male with a drug arrest in his past, making multiple trips to Columbia causes additional scrutiny. That scrutiny could come even without the drug arrest in the background.

Facts are cheap...knowing how to use them is precious...
