my brother in-law is a GC holder for 3 years. he just got married to his girlfriend in indonesia a month ago. she has a c1/d visa.

so he wants to apply B2 visa for her, so she can visit him.But not only they denied her B2 visa,they also revoked her c1/d visa.

they didn't say any reason why they did those such a things.

i really feel bad for them,because they just got married and they have to be apart.

it really feels like nothing we can do about it,except just wait until he gets the citizenship which is take forever,because he always go out of US every 6 mo to see his wife.

is there anyway that we can do to fix this situation? i really need some help here.

i'm actually not surprised. the girl had a crew-man's visa, was trying to apply for a tourist visa, all while she was a 'high risk' for immigration because she is married to a US resident. unfortunately, there's not much to be done....your BIL can fill out a spousal petition for her, and wait for that to be approved, or wait until he gets his citizenship and petition her as a citizen...but the fact that they are now married makes it highly unlikely that she'd qualify for a non-immigrant visa type....the chance that she'd use said non-immigrant visa and immigrate is just too great.

If he wants her to move to the US - then he waits. They pulled her visa because they considered she had immigrant intent.

He could move back home.

Presumably they was fully aware of the situation before he got marired, how did they intend dealing with it?

The Jakarta embassy is very strict on this, even if your friend was a USC there is no way he could have gotten a B visa for his wife. They did it to us, assumed marriage = immgrant intent. Didnt matter we already filed and paid and were waiting for the legal immigrant process, we just wanted to see each other. Not even the wrath of congress (1 rep and 1 senator) could change their mind lol....we waited apart for the visa approval
