Be careful of what you are doing. You are messing with someone's wife. You could just be another scape goat for her. If it's your turn and she is not satisified with you, she would also leave you and find another man. Same thing she is doing right now with her present husband.

this is exactly what i thought when i read about your problem. be careful, she could also be using you too. how does one "not turn out" the way you want them to? ok, it sucks if he's lazy, not attentive, etc. but surely she had "some" inkling of his personality??? enough to ignore and come here? i mean...i dont know the person or the situation, but this doesn't sound entirely kosher to me.

Timeline:

Sent in I-130 form: 01/29/09

Interview Date: 11/08/09 (APPROVED!)

Visa in Hand: 11/12/09

POE: 01/30/10 (!!!!) at JFK Airport in NYC... can't wait!

Got the green card maybe 8 weeks after 01/30/10...

The title of your post is "WANT TO MARRY A GIRL....ETC.

And, then you say we "fell in love...right or wrong, it happened". And, then after a few days of lambasting you for being involved with a married woman, you change your story to "nothing happened?" Your initial posting gave all the "hints" of a sexual relationship between the two of you. Your title indicates that you want to marry this woman whom you've known only briefly. And, all the stuff that you've said about him is mostly "HERESAY"....in other words, she's telling you. Do you even know the man? Why would her family pay the fees to bring her to the USA? That makes no sense....he married her. There seems to be some inconsistencies in your posting.

I'm sorry but I don't understand why you would even consider a marriage or relationship with this girl/woman. This has all the earmarks of someone using another person to obtain a Visa. Leave her alone and find another girlfriend...this girl is bad news. Once a cheater...(physically or affair of the heart)....always a cheater!!! Can you honestly tell US that you would be trusting of this woman in the future...after seeing what she's doing behind the back of her husband? Wake up and smell the coffee....run in the other direction and FAST!!!!!!!!! You would consider this woman as a wife AFTER her divorce from this man....I wouldn't...and I doubt many other VJ'ers would either!!!

03.16.2010 I-797 NOA-2 Approved and sent from California Service Center 71 Days from NOA-1

03.16.2010 USCIS sending notification of the approved application/petition to the National Visa Center.

03.23.2010 NVC sent file to U.S. Embassy in San Jose, Costa Rica! SNJ2010XXXXXX

03.26.2010 Received NVC letter (hard copy) dated March 24, 2010 in the mail.

03.27.2010 File arrived @ U.S. Embassy.

04.07.2010 Embassy called for Elsie to come and get Packet #3. She will pick up April 13th.

04.08.2010 Embassy e-mailed Packet #3 to me today.

04.15.2010 Interview scheduled for 30 April 2010

04.30.2010 Visas approved...pick up everything on 5/4/2010 @ 3pm.

05.05.2010 Traveling together to the USA...POE Denver, Colorado

07.28.2010 Married today...end to a long journey with more to come!!

Keeping emotion out of it, and strictly answering your question, you need to find out if she entered on a K3 or CR1. K3, she does not have a greencard yet and were she to divorce her husband, would need to leave the US. Even if you were to marry here before she left, she would still need to go back to the PI and restart the process.

If she is on a CR1, she has a greencard and is free to stay here and could technically marry another man (after divorce) and stay. If she does have a green card, it would be conditional since she has been married less than 2 years. If she and her husband were to file for a green card now, she may or may not receive a conditional GC due to the close timing of their 2 year anniversary. If she does get a conditional greencard, she can file for removal on her own, but at removal of conditions your situation would raise questions.

Immigration-wise, you have a while before you need to worry. However, affairs of the heart are still affairs (worse in my book). Step carefully.

EAD/AP approved Nov 26 '07

Got the AP Dec. 3 '07

AOS interview Feb 7th (5 days after the 1 year anniversary of our K1 NOA1!

Stuck in FBI name checks...

Got the GC July '08
