Anyone know about the mythical temporary EAD?

Hey all,

Your advice was so helpful last time I posted so I imagine you guys know the answer to this one too!

My husband filed his I-485 and I-765 in February. On our receipt notices, USCIS has written March 20th as the day they received our applications. The receipt notices were actually not sent until April 5th. OK, so the question is this: My husband has heard "through the grapvine" that if you don't have your EAD 90 days after you file for it that you can go to USCIS offices and get a temporary EAD. Today is June 20th and he really wants to go get his EAD (he has a job waiting for him and is itching to start working and stop doing home improvement projects around the house!). However, we don't even know if this 90 day thing is true and even if it is, are they counting from the day they received it (March 20th) or from the day they sent the receipt notice (April 5th).

3/10/2006: USCIS sends receipt notice for I-130

4/5/2006: USCIS sends receipt notice for I-485 and I-765

4/20/2006: USCIS Biometrics Appt.

5/30/2006: USCIS approves I-130

7/13/2006: I-485 Interview Scheduled!

The interim EAD can be requested 90 days after the receipt date for most District Offices. There are evidently a few that will only issue 90 days after biometrics.

You will in all likelihood be able to get an interim EAD immediately. Make an infopass appointment, and bring your NOA1s, a copy of your filed I-765 as well as a new one, your biometrics appointment letter, as well as an ID. They should issue the interim on the spot. Good luck!
