Uk girl engaged to an American guy

Hi to everyone in here. I met my guy online in Dec 2007, but we knew of each other before really getting together. We've been together 16months now & we are engaged. We are so happy that we met the way we did. He is my soulmate. I took my first trip out to America March 2008 & stayed for the two weeks, so i could get to know him better. You just know when you have met the man of your dreams. It was hard to return home to the UK. Then i planned my next trip back over & this time i was gonna stay much longer 3months in total. So i returned again in August 2008 til nov 2008.. Before going home in Nov he proposed to me which i was totally over the moon. So we are planning to be married at the end of the year.. Plus i'm going back out to America again in April for another 3months. I'm needing some advice on what should we be doing in order for us to get married? Does he need to apply for a K1 visa for me?

Any advice would be much appreciated. All we want is to be together..

Well, the first good step you've taken is to stumble across this site. You'll find VJ a very useful source of information about the US immigration process. I would suggest reading the various Guides and FAQs here. This should help you determine if you are best off filing a K-1 fiance visa and marrying later, or marrying first and then doing the CR1 or K3 route. It doesn't look like DCF will apply to you, since your fiance is in the US and does not reside in the UK.

Once you do pick a visa path to follow please fill in a timeline here on VJ. It's very helpful both to yourself and the greater community here.

K-1 Visa is most likely your best option. But do see what visa do we need before making any final decisions. See the K-1 Guide for a checklist of what is needed to file. You will also want to read through this thread and the links provided in it.

It's important that you understand that the process can take some time. See the K-1 flowchart. So it's important to get started asap if you're planning an end of the year wedding.

Please be advised that, no matter what you're told, it's not as simple as coming into the US and marrying him then adjusting status. If you come into the US on a visitor's visa with the plan of marrying and then immigrating that is considered immigration fraud. You can, however, come in and marry and then return home to await your spousal visa.

The above poster is correct in that finding VJ this early on is a definite plus! Welcome. :)

Hi:) congrats on the engagement--and saving yourself $$thousands of otherwise lost atty money with this site.

And by the way, im a big Russell Brand fan, so kudos to the Brits for producing him, and Soffie Allsopp from HGTV!!

The best benefit of applying for a K1 -fiance visa is that you can start the clock immidiaitely (if you have plane tickets, and other evidence like photos and emails, and phone logs).

If he petitions for you now, the clock starts immediately - (the 4-6 month clock of getting his petition approved). After his petition approves, add a couple more months for you to get your interview, and then you get your visa, and you come here, and have to marry him within 90 days.

You see, if you come back here or he goes there to get married, and then he petitions for a Spousal Visa instead--you have just lost all the time it took between now and the point of getting married--you see? and its the same amount of time roughly

So go ahead and have him petition for you right away, so you start the clock now!!

I think that the question is would you rather be apart while you're waiting to get married and then be together forever, or be together but then be apart when you're married and awaiting spousal visa? If you go for the K1 option (which is what we did), be prepared for it to take anywhere from 6 months to a year. Ours took 8 months. If K1, I recommend that you don't plan a wedding date until you at least have a visa interview date if not the actual visa in hand. Another consideration is that you cannot travel to the USA whilst you have a K1 visa being processed so if you're going out in April, maybe file for the K1 as soon as you get out there then hopefully you'd only have 5 months apart... Good luck with the decision making!

That is completely untrue. Many people have successfully visited the US during the K1 process without incident. The only time it might become an issue is you have had several long trips to the US. then they may question you and deny entry. Plenty of UKers visited for a few short trip and had no issues.

Please don't make blanket statements that will needlessly scare the OP. The is NO rule that says you can't visit during the K1 processing. In fact, Immigrations don't even know that a petition has been filed.

I would go ahead with the petition for the K1 visa, and I wish you luck with your journey, there are a lot of very knowledgeable people here to help, and the guides are a great start, We have done it with the help of VJ and a lot of reading as long as you take it one step at a time it is not daunting, just a lot of waiting!!

My fiance was denied entry (admission withdrawn) and cannot visit me. There are a few of us recently with this issue, see here:

However, being turned away at the US border is by far the minority, so I would not worry about it.

She never even mentioned using the services of an attorney. Please remember (as quoted on the home page for this website) that "this site is no substitute for the valuable help and advice a good attorney can provide!"

And just so you'll know, her fiance cannot easily marry her in the UK. The United Kingdom will not issue a marriage license to citizens of the UK if their partner is from another nation. The non-UK citizen MUST possess a fiance visa to marry over there. He cannot just visit her, marry her and then return to the US and file a spousal visa for her (as aliens can do in the United States).

Yeah i know what you mean there. Like i say we would like it to be the end of the year, if not then early next year, so that way we know that we are gonna do it the right way.
