Timeline

I'm gathering documents and filling out all the forms. For I-864, my husband and I are using my income to qualify. It says that we need to include proof that the intending immigrant's income will continue from the same source. Do I need to get a letter from my employer? Can I just provide the last 6 months of my pay stubs? I also have a letter from my employer saying what my salary will be for this year. Would that work? I really don't want to bother my employer for a letter. :(

03/04/11 -- mailed I-751

03/07/11 -- I-751 received by USCIS (Day 1)

03/10/11 -- Notice of Action received (dated 3/7/11) (Day 4)

03/18/11 -- biometrics appointment letter received (dated 3/15/11) Scheduled for 4/5/11 (Day 12)

03/21/11 -- completed biometrics early! (Day 15)

04/19/11 -- got approved and card production ordered! (Day 44)

04/23/11 -- received 10-year green card in mail! (Day 48)

3/6/09 -- got married!

3/9/09 -- medical exam

3/13/09 -- got medical results back

3/14/09 -- mailed I-130, I-485, and I-765 packets

3/16/09 -- packets delivered to Chicago Lockbox at 11:47 am and signed by R Mercado (Day 1)

3/23/09 -- Notice of Action received for I-485 and I-765 dated 3/20/09, but not for I-130 :( (Day 8)

3/24/09 -- Notice of Action received for I-130 at my husband's address (Day 9)

3/26/09 -- Notice of Action for biometrics for both I-485 and I-765 arrives! Scheduled for 4/8/09. (Day 11)

3/28/09 -- completed biometrics! 10 days early! (Day 13)

5/1/09 -- received an interview letter for 6/4! (Day 47)

5/5/09 -- EAD card production ordered! (Day 51)

5/11/09 -- EAD approval notice sent (Day 57)

5/14/09 -- received EAD card! (Day 60)

6/4/09 -- Green Card approved at interview and card production ordered! (Day 81)

6/10/09 -- Welcome letter received (Day 87)

6/13/09 -- I-130 approval letter received (Day 90)

6/16/09 -- Card production ordered (again???) (Day 93)

6/29/09 -- Green Card in hand! (Day 106)

Inclusion of a letter from employer is optional. So, it is not "required", but I strongly recommend to include such letter.

We used my income for I-864 of our AOS application (I am the immigrant). My employer has a standard language for the employment letter such as when my employment started, my position and my annual salary (I think employees ask this kind of letter for apartment hunting, etc. all the time), but I asked to include the sentense that I am a full-time employer in addition to such standard language to show my position is not seasonal or temporary.

I would not say it's "optional", it's not required, but when you need to show something, "more is better"

the instructions for the I-864 state:

First, the income must be continuing from the same source after he or she obtains lawful permanent resident status, and second, the intending immigrant must currently live with you in your residence. Evidence must be provided to support both requirements.

So you should provide the letter from the employer to show you still have a source of income (if your the immigrant), along with any other evidence (Tax returns/pay stubs/residence).

Remember, you want to include enough evidence to avoid RFE's.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I suggest that you write the letter with all the pertinent information and submit that for your employer to print on letterhead and sign. It should not be a big deal.

Its better of that you got a letter from your boss with the company's header stating how long, when, ur job position, income...etc..etc... so you don't receive any RFEs dated as the most current date....maybe todays date or 5 days from now but not to far out of the loop!
