OK, K1 Petition was approved, but Now I don't want to use it

If you must know, she actually defrauded me at the last minute, and ran away with many hundreds of dollars that were to be used to pay for visa and travel related expenses. She was very dishonest and irresponsible to me, and later wanted to get back together with me. Irresponsible red flag? I thought it was a hard warning not to continue marriage plans with her.

I think I met a better, more responsible Filipina, and will likely want to petition her instead. I will probably go visit her in Phils in 2 months. Too many red flags of a train wreck on the first girl, So I had to cut my losses with her and move on!

^^^^Are ya serious??? You make it sound like the Philipeans (sp?) is just a processing plant that you can just grab a girl and dispose of her when your not interested any more. You met a better more responsible Flipina, umm... you should have been more sure about ur decision the first time before you wasted her time, your time, and that of the people that process your case b/c now your slowing down people that are REALLY in love and that REALLY want to be together. I would say dont bother wasting your time on the next girl, sounds like you might fall out of interest with her too. Unless you have an unknown situation that can clear some of my misconseptions up, i suggest you quit clogging up the immigration process for those who fell in love with foreigners and have good intentions of staying with them for their whole lives.

I wish you luck with your second girl. my thoughts to you is slow down and take your time to get to know each other & the girl's family. It sounds like you've been looking for this second girl to early. Hope she'll be the right one that you've been looking for!

I even had a USEM Manila Embassy Visa interview scheduled. I did call and cancel the Embassy interview. I sent (non-notarized) duplicate explanation letters to the USCIS, NVC and USEM . Since the K1 petition was already approved, cancellation is not applicable, right?

Will my previous K1 petition slow down the process of getting the NOA1 on a new petition? I do expect RFE initially for an IMBRA waiver, but beyond that, will my new petition be held up? Thanks for your input. I was reading the recent threads on cancelling K1 Petitions not yet approved, but since mine was approved for a girl I no longer want, I am unclear how this effects a new K1. Thank you for your responses. :D

I am not one to pick apart the things that others say, but there is something disturbing about what you described your plans to be. I totally understand termination the first relationship because of fraud. But you are already anticipating petitioning someone you apparently know very little about, and you are going through an IMBRA agent. That tells me there is a problem with this marriage broker, who may be taking advantage of what seems to be a sense of urgency on your part to find Ms Right. I recommend taking a break from the action and reassess the situation. I think your rapid fire petition plan will create some real red flags for the USCIS or the consulate.

I agree. Wait. Take your time for several reasons. The most important of these reasons is to not be burned twice and make sure that it is meant to be. My wife and I knew we had something special after only a few days together but didn't contemplate marriage until well over a year down the line and many long talks (and large phone bills - before we got skype) and many visits.

Another good reason to wait is because it WILL look suspicious to USCIS. Ask yourself this, is she worth the wait. If the answer is no then don't do it.

I appreciate all your replies, even the strong opinions and hurtful comments. The objective and direct answers to my sincere questions are even more appreciative. It is a sampling of honest opinion out here. Well, cupid does not have a time table, and sometimes love comes looking for us. I do know what I want in a lady, and when I see it, there is no reason to wait. My over trusting nature was taken advantage of by dishonest pinay. I am all the wiser and smarter from getting burned, so I go forth all the more confident, and humbled by the experience. I wont judge all pinays by one bad apple. It was better to find out her true treacherous character before bringing her to the states and marrying her!

I'm not sure if you can withdraw your affidavit of support at this juncture, because that will almost result in an instant denial. Instead of just emailing them or writing them a letter you should call the consulate just to be sure that they have indeed received said letter and are looking into the matter.

I do not want to judge your choice in the matter, but being too quick with finding another girl so soon might raise some eyebrows on both sides. I recommend you get to know this girl really, REALLY well before petitioning for her, marriage broker or not.

For clarity, the OP said nothing about a "marriage broker". He's simply referring to the filing limitations imposed by the law itself. If he files a second petition within a two year period, he'll need a waiver of those filing limitations no matter how he met either beneficiary.

i see a red flag but its not necessarily the same red flag the the OP saw.

the red flag i see is a "how about falling in love first" red flag. the reason that many of us that actually are in love and actually do want to get married have a hard time getting visas to do so is because some people seem to be using the system exactly like the original poster.
