So, my brother plays hockey here in the US. In september when he lived in S. Carolina he drove to Florida and bought a MASSIVE extended 2008 Yukon with shiny 24" rims. Yes, he's a baller.

He paid in cash.

He now lives in the state of NY, has a NY State driver's license, is insured, BUT still has these expired florida temp plates on his car.

(yes, my brother is dumb. i have been over and over this before with him...)

He is telling me he doesn't want to plate it in the state of NY because he didn't pay tax on his vehicle originally and they will make him pay 8% AND charge him because his vehicle is over a certain weight. Because it is an expensive vehicle, he told me this could be between 5-7 thousand dollars.

His season is done soon and he will be going home to Ontario afterwards. He'd like to get the car plated in Ontario. Can he drive the car across the border with his expired temp plates and hope he doesn't get caught? He doesn't know whether or not he wants to technically import his car and pay tax on it at the Canadian border either.

Listen, my brother is the type of guy that has escaped every bad situation you could think of. He will take risks you and I won't take.

I guess what I am asking is what is the least expensive course of action or..is there not one. Do you have to pay the tax and duty on the car initially in order to get it plated in Ontario?

just outta curiosity, what's the vin number of that vehicle? if it starts with a 2, it was made in canada and maybe not liable for import tax?

Yes he does. Well he has bounced back and forth between Elmira and Binghampton/Norfolk, VA for the past couple weeks.

When my MIL was driving me to my interview in Montreal she crossed the border with her brand new beamer and it had temporary plates on it, they weren't expired but they pulled her over and asked to see ALL of her papers. These plates were not expired, they were just temporary as the car was new. This was at the crossing near Montreal. He could risk it, but they'll most likely ask about it.

From what I've heard from people he will need to import the car into Canada and pay all the taxes if the car is even legal there and allowed because it's over weight. It may not even be importable. Taxes can be big though if he bought it in the past few years...

If he is wanting to plate it in Canada - he will have to import it into Canada. That will cost him 5% GST on the purchase price. He will have to pay the RIV fee to get the federal safety - it's approx $250. There will be $100 excise tax on the air conditioning in it. There may also be a Green Levy Excise tax on it depending on the type and year of the vehicle. Then depending on the province there may also be applicable sales tax he will pay when he goes to plate/licence the vehicle.
