My partner is a US citizen, I am a European citizen....

I am trying to work out if I would need to file for a K3 or a CR-1?

Are there any major differences in the two?

I have read on the US embassy website, and I can't seem to see what I'm looking for... maybe I'm completely missing something?!?!

Definitley go for CR1 it will be cheaper, plus immediate green card upon arrival.

I-130 petition for Sibling

07-19-2012: Sent I-130 via Priority mail

07-23-2012: I-130 received by PHX lbx (forwarded to california)

07-23-2012: Priority date

07-30-2012: I-797 receipt received

1. CR1 [Completed: 2009/Total Days: 325]

2. ROC [Completed: 2011/Total Days: 222]

3. CITIZENSHIP [Completed: 2012/Total Days: 125]

4. US PASSPORT [Completed: 2012/Total Days: ]

CR1 within 6 months and if you go for k3 it will be 8-9 months

Actually, the timeline depends on several factors including the country but the timelines are similar. I would say 6 to 9 months is the normal ranger for any spouse or fiance(e) visa path.

Sorry... I just thought to ask this question:

While I have previously only thought about the spousal visas, is there any benefit in getting a K1 instead and getting married there??? Will the change of status be quicker/less hassle? Will there be a guarantee that I could stay there? Will I definitely get a K1 to enter and marry (any idea of timescale on this and can I travel to the US while the application is in???)?

Sorry for so many questions....if any of you might have any experience and can offer advice I would really appreciate it!

K1 is faster really in the approval from the USCIS ..but when it come to the embassy its totally the opposite

but studying the cases everywhere it was to clear that most of them apply for administratve processing (not all but most )

and tat lead sometimes to delays up to 2 years believe it or not

another are approved and get the Visa is days .

beside that the K1 one have the same Issues of the K3 ..which is MUCH money and paper work when u r in the US ...

why the hurry while u can get a better chance and position applying for a CR-1 ?!

my advice ..keep with the CR-1 ...easier ..more granted ...and less money .

There's no real hurry, except that I want to be there with him sooner rather than later.... as soon as possible... and want to explore every option before I make any application!

Visas are used to enter the USA, as such they are applied for abroad. It doesn't matter where the beneficiary/applicant is located at the time a petition is filed. In some cases, no visa is needed. The immigrant already in the USA may be able to simply adjust status.
