Hi,

I just became US Citizen. I've my parents, one brother aged 24 and a sister aged 20 in Nepal. I want to bring all of them to the US (if possible).

Do I need to file separate petitions for all individuals?

If I file a I130 petition for my dad only, can my mom and my sister under 21 can come with him as his relatives?

It seems like my brother will not be come sooner than 7-8 years, but I was expecting if something can be done for my sister. If I apply for her, it will still take a long time. Just wondering if she can tag along with my parents.

Any other information regarding this topic is greatly appreciated.

You must file I-130s separately for all individuals.

Mom and Dad filed will be classified as Immediate Relatives and will most likely get immigration visas within a year if all requirements are met. There is no derivative beneficiaries allowed, so only the petitioned for individual can get a visa; no spouse, no underage kids, no one else.

Your brother and sister will be placed in the F4 preference category, USC petitioning for a sibling. That will take 11-12 years. They can be married and they can bring a spouse and unmarried children under 21 years of age with them as derivative beneficiaries are allowed.

Alternatively, your parents once they have immigrated to the US can file for your brother and sister in the F2b preference category; LPR filing for child 21 years and older. This will take 9 years. They CAN NOT be married and they can bring unmarried children under 21 years of age with them as derivative beneficiaries are allowed. Getting married with a F2b petition will cause the petition to be automatically be denied.

Hi YuAndDan,

This is for the benefit of newbies.

I want to point out that the post from yesterday involves Filipino beneficiaries. Generally, they have the longest wait for immigration visas among all immigrants as there are visa caps/limits for the Philippines, India, mainland China, and Mexico.
