Anyone get I-130 approved 1st week of march?

Hey guys..sorry I have a busy day at work today. Anyway, my lawyer is the same way he says to wait until we hear from the NVC. But when I spoke to the live operator she said I can send it over. I need to wait for my wife to send the PCC and birth certificate from Mumbai, so as soon as that gets to me I am going to send it to my lawyer and he will send it in. I also need my 2008 tax info. My lawyer seemed to be ok with sending everything as soon as my wife's info arrives here.

WHat did u mean there is something he is not telling me?

Maybe some new rule that got introduced during 'green' process that we non-lawyer people don't know, that's what I mean by "he's not telling something".

HMMM... I don't see what the big secret is This whole going green had to happen just when we got to NVC after 7 1/2 wait at USCIS Definitely not fun and has our lawyer confused with outdated info!

Thanks for the response. I just got off the phone with NVC and was told to send everything in. I too await for my husband's DS 230 to arrive and as soon as I have that, there is no way I am waitingggggg!! I will make sure my lawyer gets a move on it!

Still at work and suppose to be working on 'goal for this year' BS... Just got done with printing out AOS package material. Once I get home and eat cheesy/unhealthy food, I'll finish up the package and be ready to send tomorrow morning. :D

Are you guys showing your 2008 income tax returns in the package you are sending to NVC? Did you all file jointly? Did you get tax ID number for your spouse? Does anyone know if this is a problem?

Are you guys showing your 2008 income tax returns in the package you are sending to NVC? Did you all file jointly? Did you get tax ID number for your spouse? Does anyone know if this is a problem?

I am taking a risk in this scenario. I've not yet filed 08 taxes (this is the usual thing, my accountant usually files towards the deadline). I do not plan to file tax returns, but instead I'll file extension for this year which is valid till Oct. 15th I think. My plan is to file jointly once my hubby gets here. The risk I am taking is, embassy may ask for tax returns during interview time. I am not sure if they'll be happy with a copy extension or not. Let's see what happens....

My lawyer also gave me the option of filing married but individually...does anyone know any negative aspects to doing this?

WHen I called NVC today they said since we didnt pass the deadline of APril 15th tax day yet, we arent required to hand in the 2008 tax return yet but at interview time it might come up.

I actually emailed my consulate directly and was told filing single won't be a problem since hubby is not in the US and does not have a green card yet. So on their end they do not expect to see MFJ, but will definitely want to see my 2008 tax returns at interview time. But single in their case is not a big deal. So my advice get in touch with ur consulate directly.

I know some ppl are filing jointly by submitting A W7 with their returns but that makes things a little complicated as u need to get ur SO to sign and return the W 7 before u can file and April 15th being right around the corner, some like me are choosing to go the single way and amend taxes once SO is in the US . Ur best bet, call IRS.

Yes I did as a matter of fact I have gotten more answers from my consulate and NVC as I have ever gotten from my lawyer I can never sit back and let things take their course if I have a say in it, I need to ask my qs and find my own answers and no I am not paying an attorney an overpriced $395 hourly rate just so he can get me an answer I can get by sending a free email.

Since our spouses dont have SSN , this is a fine safe way to quickly get all the documents also. I am going to file single , unless I hear that the consulate in India has a problem with it. I however did talk to my friend whose spouse just came on CR1 visa last month, and he filed single on his tax that he gave to the NVC.
