Fingers crossed. My husband had a couple of driving tickets. We included court reports - I hope that is enough for them. Apart from that I was very meticulous with our docs. Please - no RFE!!!

I just found out I am a potential candidate for RFE. I had not included anything for 2008 taxes. I just called operator and she said they're going to start requesting 2008 tax returns for everyone whose case is still under review after April 15th. This sucks!!!!

Champi I am in the same rocky boat along with u regarding this tax fiascooooo. Did the stupid deadline have to coincide with our case review??? But an operator just told me at this time they are not yet requesting '08 taxes

Called the IRS and somehow they just received the tax return today so it will take 3-4 weeks for it to be processed and until then I can't get or even request a transcript. NVC says they will only take the 2008 transcript.

So frustrating. I can't believe it.

Sattva, why didn't they accept ur '08 tax copy? And I see on ur timeline u had an RFE for AOS, is that what the RFE was?

I am frustrated as well. BIG TIME!! How long does it take to review 2 freakin forms!! I want to go over there and help them read them so we can move on! They better get our case completed b4 april 15th so they won't RFE us for the 2008 taxes as I haven't filed yet!

I'm sorry to hear this guys... I think all of us may end up in same boat for one reason or another. This is really bad on NVC part to change rules at their own will. I-864 clearly states photocopies as acceptable.

"You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income taxreturn for the most recent tax year."

sattva - you should call back and ask why they made this requirement when I-864 forms clearly states "photocopy"...

Did you provide 3 yrs of tax records (2005,2006,2007) + regular copy of 2008 taxes filed?

If you provided all the years above you should be fine....double check with NVC as everytime you call you get a different story from the operators

I have 3 years of tax transcripts (2005, 2006, 2007) and Tax Return 1040A including Form W2 and Form 1099? Should I list just the 2005, 2006, 2007 in the I-864? Or better to list 2006, 2007, and 2008?

ok as it was explained to me now, they are requesting a photocopy of the actual 2008 tax return - the statement from the IRS that your taxes have been processed/paid - not a photocopy of just the forms you filed.

this operator also confirmed that you need the 2008 tax return after April 15 anyway. so if you haven't filed, you may want to do so ASAP because you need the tax return not just a photocopy of the forms you send to the IRS. I sent my 2008 taxes by mail so I'm out of luck as it takes about 3-4 weeks to process the paper version 1040. If you qualify to e-file, you should be able to get a tax return faster.

i'm really really sad that this is probably going to add another month to the processing time.

hope this doesn't affect too many people

There was information on the AVR that said my financial evidence had been reviewed and that they were sending me a checklist of the information that was still needed. I spoke to an operator to find out what the information was. She told me they would be sending the list by e-mail but that all I needed was the 2008 tax return. I then spoke to the IRS, called NVC back to see if I could just submit 2007 instead and then called a third time when Champi reminded me about the photocopy instruction on the form. The third time I asked about the photocopy and he put me on hold to get clarification.

you are not alone then. we also didn't include the 2008 taxes, but let's hope our case is out of review before day 15!!!! I think you will bee fine

I finally found a solution if I run into this issue and thought to share it with you. I am total dummy when it comes to taxes, never done it myself. I was stressed after reading about sattva's experience. I finally found out that if you e-file tax extension, you can get confirmation from IRS within a day. Here is the link to it:

I had another nightmare to deal with today. Our accountant had done zippo on filing my extension. This added to my stress. First thing I am going to do tomorrow is walk into the H&R block, find out their availability/fee, etc, and then take my W2s, 1099s from my old accountant and hand them to H&R Block if they can fit me in. Not to forget, I also found out I possibly made a mistake on my I-864 that can mean an RFE. This has been an absolutely disastrous day for me. I really need a new day tomorrow with some positive news.

Will that deter me I wonder?? But then again I don't think it's legal for them to hold that against you....Hmmmmmmm..... Guess wil ask NVC about it.

Champi, why don't u call NVC and ask them about it. They will have an answer for you. When I was filling out the forms, I called and asked about the ones I was unsure of. I remember having a conversation/debate abt this with my lawyer's assistant and we ended up putting N/A since I am the only person whose income is being considered and I am the USC. Hopefully we can all get by w/o any RFEs and before this tax issue being a problem

Thanks to you for sharing this Because of the information you provided, I have decided to e-file my taxes (instead of extension) and amend it later on. Hopefully if RFE is there to come my way, you saved me couple weeks of delay
