When me and my ex wife were going through a divorce we had dualing protective orders on each other. Well i was stupid and was in here vicinity and was arrested and pleaded guilty. Never been arrested or convicted of anything else in my life.

With that on my record will I automatically be denied the Visa for my girlfriend. She is aware of the conviction also.

Honestly have a clean history except for that and I realize the mistake I made. Thanks for any help with this.

There are questions to answer if you have been conviceted of certain acts and then if so things you have to provide. Assuming you were mearly too close to the ex/her home and not going something like beating the C--- out of her you will probably be ok for a one time thing. Just provide all the required info.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

"Give me your tired, your poor, your huddled masses yearning to breathe free, the wretched refuse of your teeming shore. Send these, the homeless, tempest-tost to me, I lift my lamp beside the golden door!"

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

Welcome to the USA!!!

Ok, no beatings going on, I was just at the house and she got sneaky and called the police when i was unaware. Was my fault for being in the situation and I learned from my mistake. Was a misdemeanor and i did the probation thing. Was 5 or 6 years ago. We were planning on getting married and doing the k3. Is it different between the K1 and K3 as far as how it affects the process?

Really appreciate the info, I am trying to keep my fiance informed of what we will go through. That way we can both make informed decisions.

You'll be OK either way.

Exactly. You wouldn't be denied anyway. IMBRA is about informing foreign nationals not denying USC petitions. This is not a conviction you even answer yes to on the I-129F.

Really? I don't have to mention it on the forms?

Thanks for the help in advance.

If you thought you did, you didn't read the forms carefully and interpret literally. Doing so will be critical to your success.

One more question. We met at at online dating service latinamericancupid.com does this have to be mentioned for the IMBRA thing also? The site requires one paying customer to be able to respond to the other people. In my case I paid a monthly fee and was granted "full access". It is similar to yahoo personals and eharmony.

No, these fee-based dating sites are not regarded as marriage brokers.

Right. Just check no on the IMB question. Internet dating is not marriage brokering.
