Question about taking Sponsor’s Tax Return to INTERVIEW!!!

I have a quick question, today I got an e-mail from NVC with my Appointment Letter! In the letter it states:

IF a sponsor filed an I-864 (Affidavit of Support) AND provided the NVC with

proof of an IRS Federal Income Tax Extension in lieu of a Federal Income Tax

Return, the applicant must bring the sponsor's most recent Federal Income Tax

Return to the visa interview

My question is my wife did not file for her 2008 tax return yet, because the deadline is Mid April, so can I just take her 2007 tax return?? That is the most recent one I have! Do you think they will question it???

01/04/08: Married

07/10/08: I-130 Sent to USCIS

07/16/08: Received NOA stating Case received at USCIS (Vermont Service Center)

11/12/08: Case Transferred to California Service Center

01/06/09: I-130 APPROVED!

01/16/09: NVC receive case, and issue case number

01/16/09: NVC send DS-3032 and AOS bill

01/23/09: PAID AOS Fee Online $70.00

01/24/09: Mailed DS-3032 (choice of agent) to NVC

01/26/09: AOS Fee Status PAID

01/27/09: DS-3032 choice of agent received by NVC

01/27/09: Printed Out AOS Coversheet/Mailed Out AOS I-486

01/28/09: Paid IV Fee $400

01/29/09: IV Fee Status PAID and got DS-230 cover sheet.

02/06/09: Received check list for AOS

02/10/09: Missing documents sent back to NVC

02/10/09: Mailed DC-230 to NVC

02/17/09: NVC receive DC-230

02/25/09: Case Completed at NVC

03/09/09: Got Interview date(Called NVC)

04/06/09: Interview

04/18/09: Visa received

04/29/09: POE

It would be a GOOD idea for your wife to file her 2008 taxes ASAP as there is not really any set date when USCIS will ask for "most recent year". Normally there's no huge advantage waiting to file the last minute anyway.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Well... my wife did not work in 2008, and my interview is in 26 days! Also she used her dad Affidavit of Support who owns a business and is waiting to file taxes. This is why I was I was wondering if taking her, and my father-in-laws 2007 taxes would be fine since my interview date is before the deadline to file taxes.

01/04/08: Married

Well... my wife did not work in 2008, and my interview is in 26 days! Also she used her dad Affidavit of Support who owns a business and is waiting to file taxes. This is why I was I was wondering if taking her, and my father-in-laws 2007 taxes would be fine since my interview date is before the deadline to file taxes.

The safe bet is that the answer is no, it's not ok. Nobody will know for sure unless you go to the interview without 2008 taxes. The risk and decision are for you and yours. We can't take the risk or make the decision for you.

The lawyers we were dealing with said to have the past 3 years of tax returns for the interview, but 2008 would be the best to have. Luckily for me, I'd already filed 2008 and got my refund before I even completed my Affidavit of Support.

Oh, the lawyers also mentioned something about W2s, so I've got it all (along with letter from the bank regarding bank account info) ready to go with us.

I did a little research, and from what I have concluded is that I can take my wife's 2007 tax return. I am stating why for future references if it turns out to be helpful for anyone.

1. My wife filed her Affidavit of Support using only her 2007 return and W2 (that's it), and it was reviewed with no problem.

2. In my appointment letter is states that the financial evidence was received/reviewed/complete.

3. My interview is in the first week of April, NVC states 2007 tax return can be used up until then, and that the embassies are aware of it.

4. NVC sates the applicant must bring the sponsor's most recent Federal Income Tax

Return to the visa interview for general purposes in case some peoples cases are completed or filed after the next tax year term.

5. Yes Recent 2008 tax can be request in certain circumstance such as the sponsor does not show enough income, but if AOS is complete then it should not be a problem.

This is just my opinion, I dont expect anyone to agree with it. :)

so in conclusion I will be taking her 2007 tax return, and if I am questioned I will simply state she has not filed them yet. :thumbs:

I received the email from the US Embassy in Bangkok, Thailand today addressing the same question. They told me to bring the 2007 and W2.

For me, I received the refund from the IRS. So, I will make photocopy of my direct deposit from my bank as well. In an addition, I also received a stimulus money in May, 2008, which was direct-deposited into my bank. I will make the photocopy on this one as well.

This is to prove that you filed the tax and received the refunds both ways.

Regarding 2008, they might or might not ask. I plan to file an extension. SO, I will bring my W2 for last year as well as the copy of my extension form.

I had my interview and it went great! :D I took my wife's 2007 tax and they did ask for the recent 2008, I just told them that she did not file them yet, and they said ok that is fine... :yes: I got my visa in 12 days so i am really happy. Just thought i would clear up the tax issue after my interview. Thanks for all the help!!
