dear friends i have question that when u r called for deffered inspection by custom and border protection in marriage cases can they deport you ? my case is that my spouse filed for divorced and got divorce from me and then complaint to immigration that my marriage was not in faith (which is totally wrong). now i m very much concerned abt my stay in states .CUstom and border protection ordered me to appear in person at the airport for deffered inspection . some people r saying that they r gonna deport me and some r sayin diffrent things ,i dont know , i m confused . any help or suggestion will be appreciated.thanx

yes everything is in order in my passport . they did stemp that i was being paroled after they took my Conditional GC.and yes i just came into usa from abroad trip

From what I'm reading, it sounds like a divorce got ugly. If you have evidence that your marriage is bona fide, they won't be able to deport you no matter what your wife said. Especially, that's if, your wife has any criminal history, even those juveniles cases, then it's what the lawyers called "discredibility", I call it "the history of pattern of lying/criminal behavior". I'm guessing she did that just to hurt you or hope that you'll get deported so she will never have to worry about seeing you again. As far as I know, if the marriage was not entered in good faith, she herself is facing federal jail time, assuming she knew it was not in good faith from the beginning. My point is, if the marriage was not entered in the good faith from the beginng, why only bring it out now? If the marriage was entered in good faith, and when right after the divorce, it became not in good faith anymore, definitely a divorce got ugly. If you don't have the evidence, then start gathering now. Before they deport you, you will have to face an immigration judge. Then it'll be your last chance to say what you need to say and present the evidence to prove that your wife is lying. If you are really going to the airport, don't go there without an excellent immigration attorney. What your wife did was very uncivilized, because even if the deportation is unsuccessful, you would still have to spend time on worrying and spend tremendous amount of money to hire an excellent attorney. Just one complain to immigration then you're in so much trouble. Wow, we chinese said "the most poisonous thing is a woman's heart", I think that's true, and that's probably why there is a kind of very poisonous spider called the "black widow".

7/22/2010 - Online status changed to "Case sent to local office for interview schedule"

7/27/2010 - Received interview letter for 8/23/2010

8/23/2010 - Passed interview, was informed that next oath date is 9/22/2010 and oath letter will come in the mail

9/3/2010 - Received oath letter in the mail for 9/22/2010

Wow this is sad, but if you are called to appear at the airport what else can it mean?. They are not askng you to appear at a court or immigration office. hmmm strange.

I agree, if you don't show up you will become a fugitive!. I've heard that the worst thing to do is sign a paper where you admitt any fault, so don't sign anything!. Get a lawyer immediately!

Make sure you get a lawyer a good one before you go to the appt. If you do go by yourself to find out about the nature of your presence, Do not sign any papework admitting guilt without a lawyer present, If there's anything you don't understand from the paperwork tell them you'll consult your lawyer about it and reply and send back the response/papers to them.

What did CBP say to you at the POE when your green card was taken and you were paroled into the USA? Were you given an I-94? How long were you out of the country?

Deferred Inspection is the process of allowing a person into the U.S. on a provisional basis, requiring him/her to return to the Port of Entry (POE) at a later date with specific additional documentation demonstrating admissibility. This process is invoked if it is unclear to the Inspector at the POE whether the individual is eligible to enter the U.S. but it is believed the necessary information could be obtained after he or she reaches the US.

It would be wise to consult an immigration attorney before going to CBP, just to be sure you know what you might be facing. As an LPR, it's unlikely that CBP would proceed with ER (expedited removal) since you are afforded a hearing with the IJ. However, since your green card was confiscated, right now you have no proof of status, so I am not sure what to expect. What ever you do, take any evidence of the bonafides of your marriage with you to an attorney and to CBP, if your attorney suggests you go alone.

What could you ex-wife have written and shown that would be so clear and convincing that this was a marriage of convenience?

A non-citizen may be questioned regarding their immigration status by an immigration officer either at the border, airport or any place within the U.S. A person arriving at the airport or at a border crossing may be detained immediately or referred to deferred inspection if a computer check reveals a criminal conviction, pending criminal case or criminal warrant. Deferred inspection refers to an interview at the local Customs Border Patrol office (CBP) to discuss the immigration problem in more detail. The CBP is a division of the United States Homeland Security. A person with a criminal conviction will likely be asked to show up at the CBP with a copy of the criminal disposition record.

If you think your immigration status is questionable because of a criminal conviction or other problem, you should seek the advice of an immigration attorney on what to do if you are detained and interrogated by an immigration officer. After consulting with an attorney, make sure that you keep the attorney’s business card and contact information in your possession at all times. If you are detained or arrested, tell the immigration officer that you want to speak to your attorney right away before answering any questions.

they just took it and told me that my X complained abt me something .and told me that they will send me GC to my local airport and they will determine wht to do .

May 10th I-130 Packet and Packet 3 sent off to me by the U.S. Consulate
May 16th -Received Packets 1-3 from the U.S. consulate
June 29th -I arrived in Puerto-Rico!
July 2nd -Married in Mayaguez, Puerto-Rico and also got our interview date for September 6th
August 17th -We arrived in Australia to file for Sep. 6th
September 6th - Filed DCF in Sydney and approved 1 hour later!
September 12 -Received my passport with the visa and yellow packet
November 24th -POE.......Guam,USA
December 12, 2005-Green Card arrived in the mail
September 11, 2007 -Filed I-751 on conditions
September 17 -VSC Receives my I-751 and issues NOA1
Oct 10 -Had biometrics taken in San Juan, Puerto Rico ASC
Oct 12 -Touched.
Aug 21, 2008 -Approved!...........finally
Sep 17, 2008 -Mailed off N-400
Oct 22, 2008 -Biometrics taken in San Juan ASC
Feb 12, 2009 -N-400 Interview
Feb 26, 2009 -Oath.....the end.

she said i entered fraud marriage and went away right after i got the green card. and also said that i was married and had children before i marry her (which is totally lie).
