It`s me, the stupid confused guy again! I am really not sure yet what is the best route for a visa for my case. I ve had some claim that the best way is the K-1, no doubts. BUT, the K-1 does not allow you to get married in her home country, it is our church/religious tradition that we get married in her hometown, so thats not an option I guess. Now to decide between a CR-1 or a K-3? The job part is not an issue, she most likely not be working anyway. What is the best way to go about this? Which visa will require the least paperwork and get her to the U.S. the quickest? Does one of these two allow you to begin paperwork before you have a marriage certificate? I realize I have lots of questions but I am just trying to find the route I going to take!

12/29/2009 I-130/I-485/I-131/I-765 sent to Chicago

1/11/2010 Packet sent again, check was wrong the first time

1/15/2010 NOA 1 for all 4 forms

1/29/2010 Letter for Bio on 2/17

2/1/2010 Bio Done

2/1/2010 RFE received for I-693 medical

2/12/2010 RFE received at Lee s Summit, MO office

3/4/2010 Letter from USCIS for interview date of April 15 at 9:30 A.M.

3/10/2010 EAD card production ordered

3/18/2010 EAD and AP received!! Now waiting for the interview!!

4/15/2010 A good interview! Approved for 2 years!

4/26/2010 Green Card received in mail!

to decide between K3 and CR-1, obviosuly CR-1 is a more superior visa. you can read the benefits on this website. in terms of paperwork, there is a lot less paperwork involved with CR-1 and is less costly. they both are taking about the same time to process these days (in some cases CR1 is faster). so my vote is for CR-1.

and no, you cannot apply for either K3 or CR-1 without a marriage certificate. by petitioning a I-130 for your spouse you have to prove that you are legally married to your spouse.

you say superior? Just wondering, what makes it a superior visa? I looked at the comparison guide, I guess its kinda hard for me to comprehend exactly what makes the CR-1 better? What is the price difference? I have not seen a filing cost for the CR-1, the K-3, is $355 correct?

superior as you get a greencard almost upon arrival. K3 doesnt give you this privilage. you have to apply for adjustment of status if you choose K3. the price difference at the end is, i think, about $500. $355 cost is for filling an I-130 petition. you will have to file this petition no matter what route you choose.
