Hello we sent in the AOS package but my spouse didn't have her I-94 but did have the B-1/B-2 stamp inside the passport she had. I sent a copy of the passport along with the B-1/B-2 stamps but she didn't have an I-94. Will that cause our I-485 to be denied, will they send a RFE? or will they accept the photo copy of the stamp.

The instructions do request copy of I-94, but I have seen many cases where a person had crossed into the USA at a border crossing where an I-94 is not issued have no problem.

Thank you for this information, it really makes me feel a little bit better. Also, one last thing. When it ask "Current USCIS Status" I put none, did I just mess up the whole thing.

10/22/08 (Day 1) - Received Date (USPS over night)

10/29/08 (Day 8) - Check Cashed

10/30/08 (Day 9) – Received NOA (I130-I485-I765) Dated 10/31/08

10/31/08 (Day 9) - I130, I765, ONLINE BUT I485

11/02/08 (Day 12)- Received Biometrics appointment scheduled 11/15/08

11/07/08 (Day 17)- Biometrics Done Early walking in Norridge,Illinois

11/17/08 (Day 27)- Request for Evidence letter for I485 (they were asking for I94 Arrival record) It took 5 days to arrive online letter was sent 11/12/08

11/18/08 (Day 28)- Request Evidence is I94 sent along with I20,( I was a student), NON immigrant visa page on the passport, also, approval letter of F1 status, because i changed my status after i came to USA.

01/07/09 (Day 108) Card Production Order (Received email at 8:20) EAD

01/14/09 (Day 115) Card Production Ordered (another email saying EAD ordered again)

01/14/09 (Day 115)Interview Received March 9 at 11:00am Chicago office

01/16/09 (Day 117) EAD Received in the mail

03/09/09 Interview in Chicago (Day 169)

03/09/09 APPROVED (Day 169)

03/12/09 WELCOME LETTER RECEVIED I130 APPROVEL RECEIVED IN MAIL (Day 172)

Current status is "B-1 or B-2 Visa Holder"

I dont think I-94 is required for form I-485. If you filed EAD I-765 together with your I-485 then I-94 is required depending on your category.

I am fairly certain that Mexicans with multiple entry B1/2 visas are not always issued with I-94s. Canadians do not always get them either. I didn't. Anywhere that I was asked for it, I wrote, "none issued."

If she did have one but has lost it then you do need to apply for a replacement.

I hope another Mexican can come along and answer for sure, but from what I understand, this is the case.

Concurrent I-130 and AOS

Nov 30 2007 - I enter US as a tourist to spend the ski season with my sweetie and figure out what we both want outta life - we plan on ending up in Canada, but...

Jan 30 2008 - We get married in Vegas! We decide to stay in the US.

Feb 08 2008 - File I-130, I-485, AP and EAD

Feb 11 2008 - Package arrives in Chicago

Feb 19 2008 - Receive NOA 1 for everything except I-485. NOA date Feb 15th

Feb 19 2008 - Touch I-130, AP, EAD

Feb 21 2008 - Receive I-485 NOA 1. NOA Date Feb 15th

Feb 22 2008 - Receive Biometrics notice, dated Feb 20th, for appointment March 11th

Feb 27 2008 - Walk in to Denver field office and have Biometrics taken early as the 11th March I'll be away

Apr 16 2008 - EAD card production ordered

Apr 16 2008 - AP approval sent

Apr 21 2008 - AP received in mail

Apr 21 2008 - EAD card production email received again - strange

Apr 24 2008 - EAD card approval notice sent email

Apr 26 2008 - EAD card received

June 09 2008 - I-130 finally shows up online and shows a touch that day, so does I-485

Jun 27 2008 - Interview - approved, stamped, received card production email. Ya-hoo!!!!

Total time from filing - approval: 4.5 months

MOVED TO SAN DIEGO!!

Lifting of Conditions

June 11 2010 - Package mailed

June 16 2010 - NOA date

July 2 2010 - Bio letter received - July 27th date

July 9 2010 - Early biometrics walk in San Marcos CA

Sept 16 2010 - Card production ordered
