hi I am planing to petiton my dad after i get my citizenship im not sure what kind of form to submit and what are the requirements? by the way i have a brother who is gonna be 21years old this coming june 2, 2009, can i petition him together with my dad if ever i will get my citizenship in 6-8mons? thanks

You file form I-130 to USCIS.

YEs you can file for both of them together as soon as you get your citizenship. It take longer time for brother. All the best!!

One note, Father's IR-5 petition will take about 1 year to process through to an interview.

HOWEVER, your sibling is a different matter, siblings get family fourth preference for visa numbers, in the case of the Philippines this is taking more than 20 years to get a visa number issued, currently working F4 cases filed June 1986.

You must file separate I-130s petitions for your father and brother. Your father's petition will take about a year and your brother's petition will take 23-25 years. Filipinos have it bad when it comes to immigration to the US.

The quickest way for your brother to get an immigration visa is to have your father, once he is a legal permanent resident (LPR), to file for your brother in the F2b category, LPR petitioning for unmarried child. So in a year or so when your dad gets here, he can file a I-130 for your brother. It will take an additional 11-12 years. During this time, your brother should not get married. If he does, his petition will be automatically be denied since a LPR cannot petition for a married child. I bring this up because so many people have been screwed over by this.

I don't know if you are familiar with the different immigration categories. The time a person has to wait for an immigration visa is dependent upon the relationship between the petitioner and the beneficiary, whether the petitioner is a US citizen or an LPR, what country is the beneficiary from, age, and marital status.

Correct the KEY point is to marry AFTER immigrating NOT before.

This is what can happen if a marriage takes place by a F2B or F4 immigrant BEFORE getting the visa, and concealing this fact from the DOS and USCIS: Perfectly Legal Immigrants, Until They Applied for Citizenship (NOTE the headline is not correct, they were NOT "Perfectly Legal Immigrants")

thanks alot I thought my brother can go together with my dad the same time like K3 if below 21 and under guess not...thanks for all the replies...
