Filling out i-864 only using assets?

Hey guys how are you?? Just wanted to know if i can fill out the i-864 only using assets.. ive read before people have done this but havent come back to report what happened here on the forums. I have never been employed before, and just recently moved to the US a month ago, i'm a US citizen studied medicine abroad, and have never had a job before. My wife has been a nurse for the past 3 years, and our combined assets (both of our assets are money in our own individual bank accounts) is over the 3 times the 125% poverty line which is required..i just wanted to know is this good enough? Also, if so, i have 15,000 dollars of the required amount in my bank account here in the US, while the money that she has saved is overseas in her bank account. Is that ok? What would be required for me to do, just fill out the part on the i-864 about the intending immigrants savings account,and include a bank statement from her bank for the past 6 months or so? Or would it be better if she wired the money in her account into the account i have in the US? I won't be getting a job until way later this year when i start my medical residency..and really want to apply now, as it already takes 9 months at least to get approved it seems...Does anyone know of a case where the i-864 has been approved soley on assets..because i can't find a co-sponsor to help me out..but have the assets requirement... I also want to know if ive never filed tax before because i've never had work so i never had to what do i do in item 25 in part 6 of the form about "federal income tax form information", and what do i write in the part where it says unemployed since? Since i've never been employed...thanks a lot for your help, hope to hear from you soon.

Try this link: I-864 FAQ

For assets - you need "5" times to meet the level of the difference.

Say you make 10000. The level is 15000. Your short 5000. You would have to have assets that equal 25,0000 (on top of what you make)

So - using the 2009 level - for two people, which is 18,212, you would need, in assets, 91,060. (which is the difference of not actually having a job)

The FAQ will answer your other questions.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Hi bobby thanks for your reply..but you misread what i wrote, i dont make 15000 its how much money i have in the bank im unemployed, plus its 3 times the difference if the person being sponsored is your wife.. the information im asking isnt available in the FAQ for the i-864...again would someone please be kind enough to help me answer the questions that i stated above, thanks again for your help...

I've never seen anyone report they made it on assets alone. Doesn't mean it hasn't happened tho. As you may imagine USCIS would rather see a person having a steady job with consistent income.

Your best bet would be to get a co sponsor.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

well ive read about people who have been out of the country for the past several years, that dont have tax forms, or a job and applied based on assets alone... i guess i could try to get a co sponsor if i must, but really i hope someone who has answers could reply if you have gone through something like this thanks..

Srac, I've been following your posts and nobody really has the answer you want. Where have you read about people who did the same? Can't you contact them? This is a really specific case, so most people here won't be able to help you.

Seriously the best thing you can do is calling to the National Visa Center (NVC), the phone is (603) 334-0700.

They are the ones who will receive your I-864 when you have your I-130 approved, so maybe they are the right people to answer you that.

When you call, please come back here and give us an answer. :)

We did this, it was no problem. We bought a house in the US (no mortgage on it) and I showed the evaluation of that at my interview, and also an online statement from my husband's US based bank account.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

If the cash assets are largely "new" to you or your fiance that could cause a red flag. You did not indicate your wife's country. If she's from a higher fraud country than you want to be sure to prove that the cash isn't just a quick transfer to meet the requirements.

Will your wife have licensure when she arrives in the US? Her being eligible to get a nursing job soon after entering could help to address the "considerable hardship" question regarding asset conversion. Quoted from the I-864 instructions: Only assets that can be converted into cash within one yearand without considerable hardship or financial loss to theowner may be included.

Your correct, for your wife, it would be 3 times, if you are the only one providing the assets, you are not, she is going to share, as you stated.

You have ZERO income. You would need 3 times the difference for your assets to count. The current level for two people is 18,212. So, 3 x 18,212 = 54636.

If your total assets is equal to 54636, your good to go. You do not have that with your assets alone.

However, based on the FAQ I linked, it says this:

Can the immigrant visa applicant count assets that he or she owns that are outside the United States, such as real estate or personal property?

Yes, under these conditions:

* The assets must be readily convertible to cash within 12 months

* The applicant must show that he/she can take the money or assets out of the country where they are located. Many countries have strict regulations which limit the amount of cash or liquid assets that can be taken out of the country

* The assets equal at least five times the difference between the sponsor's income and 125 percent of the poverty line for the household size.

So, using her assets, she would need to have 5 times the difference between your income and the poverty level (you have ZERO income) 18212 X 5 = 91060.

I have not seen a case get approved on assets alone, I am sure there are some out there.
