Hi all,

I got a question, and this place has always been my guiding light for this sort of stuff.

I came to live in IL in 2007 with a K1 visa, got married in 2007 and got my Green Card in October 2007. The card has an expiration date of 10/22/09.

October 09 is still a little bit of time away, however I want to start now preparing what I need to do next, so my question is: what is my next step? Which forms do i need to get together? What proceedure do I follow next?

Any advice would be very helpful!

90 days before the expiry of your Greencard you can apply to remove the conditions. Have a read of the guide and start gathering the evidence you will need to have ready.

You guys will file just about one month after us. :) We are eligible to apply in late June and you, in late July. We're starting to prepare too. Start with the Removing of Conditions Guide (the link Kez/JWolf gave above). I've started making checklists and notes. For instance -

Things to do in March: make to-do lists, copy mutual credit cards, ID cards with same address, passport and green card copies, search for joint mail and copy it, copy insurance showing each other as beneficiary; April: prepare photos and descriptions of vacations together, copy itineraries, get tax transcripts from IRS, copy paystubs and phone bills with same address; May: compose Affidavit letters and approach people to sign them, print joint bank statements, request letters from bank stating we have joint accounts and credit cards, get apartment manager to write letter that we are both leasing together month to month, copy utility E bills; June: put together entire package and add paperwork as necessary, make copy of entire thing, write check and copy, finalize cover letter, SEND IT OFF!!

After all the initial stuff, tons of forms and proof, was a bit shocked my wife only got a two year conditional green card. Something about fraud, did I marry her just to bring her into this country? If I did, certainly didn't charge her enough, should be at least to cover a $250,000 fine and five years in prison, plus all those translation and immigration fees, transportation, and to ease the burden of me, hired a first class immigration attorney.

So the USCIS is worried about fraud, what to they have to lose? If I was tricked into a marriage, and many have been, not only a broken heart, but could cost me a small fortune, because our courts love giving a huge bundle of money to a woman spouse. It also can cost a small fortune just to get to know the person you are interested in, already experiencing a bad marriage that cost me a huge fortune, was far more concerned about myself than the USCIS, plus they just have a bunch of kids working there that don't know #######. My wife was fortunate to have a US visa, and we spent a lot of time together before I asked her to marry me, was no doubt in either of our minds, we are going on six years of marriage now with no thoughts of parting. Plus we had to wait another nine months due to the USCIS delays, what in the hell else do they want? The I-751 of course.

I am the kind of person that if I don't do anything now, will never do it, so read the consequences of not filing the I-751 on time, and certainly did not want to lose the woman of my most wildest dreams due to deportation. We also discussed fully which country we wanted to live in, but also knew in advance we would be making many trips to her country as that is where her family is.

Also thought it was a terrible joke in the I-751, a woman would only have to claim her husband is slapping her around and still can get that ten year card, and believe me that can happen the way my ex cried telling lies to the judge about how great she was. But still managed to get full custody of my kids, that was a nightmare in my life.

First thing I did was to download the I-751 and study it plus all the evidence they required, even filled it out, but had to update that when the time came. Big thing was to type out the due date and paste that to my refrigerator door, than about 21 months of collecting evidence. My wife had to leave many things behind, and not only wanted to share my life with her but my possessions as well, this required deed and vehicle title transfers, have four of those, but only transferred two, that cost a hundred bucks. Got by with ten bucks for the house as learned how to do that transfer myself rather than paying an attorney 500 bucks to type out a single page form. Ha, finding that form was a trick, but shared that information with my register of deeds as many are in the same boat I was in. All legal. Had to learn how to type out an affidavit, they wanted two, sent four, but could have sent a hundred. Very carefully drafted out the cover letter and signed that myself as the USC, did everything on the computer and made a complete back up copy as I heard the USCIS loves to lose applications. I went back to my attorney and e-mailed everything to him, surprisingly enough, he reviewed it, said it was perfect, but didn't charge me.

When that faithful date finally arrived, had the package completely sealed and sent it overnight to Nebraska only to get another shock, a one year extension. That was hell with my wife's employer, state started charging huge fines for hiring so-called non-documented employees, and more problems with the DVM, they never heard of a one year extension either. After a long battle, they just wanted to issue a temporary license that would expire the same date as her extension. I really got teed off and called our governor, he changed that for us. Wasn't my fault the damned USCIS is so slow. Then they lost our application from that Nebraska to California transistion, but knowing our Senator Feingold personally, he got that squared away for us.

Was so frustrated with the USCIS, we applied for USC at the very earliest date, and we finally received that ten year card just three weeks before my wife's interview, but then they lost her oath letter, another call to Feingold got that straigtened out even with a letter of apology if you can believe that.

Well it over now, five years of that stuff, and if the USCIS is reading this, yes, we are still married and living together. I am a veteran of a foreign war, no criminal record of any kind and always paid my taxes on time. My experience with the USCIS was the most humiliating experience of my life. But still most important to know without a doubt the person you are marrying is the right one.

Oh, if I had to do it all over again, would have pushed the 4 rather than the 2 button for the number of copies on my copying machine. You need just about all that same evidence again for the N-400.

Totally agreed!!! Hence, I've done 2 originals and 2 copies. One for I-751 and one for N-400 coming up next year.

Can't believe I'm already talking about next year. This year seems like it's just started but already into March. Almost 2nd quarer. Phew!

6/17/2010 - Able to see case status "Initial Review"

6/18/2010 - LUD

7/2/2010 - Called mis-information line to put in a service request for STILL HAVEN'T RECEIVED "FP NOTICE"

7/8/2010 - LUD, at 2:32am, received text msg and e-mail for req. for add'l evidence being mailed out on July 6th, believe it's for the FP

7/12/2010 - Received FP notice in mail, scheduled for 8/2/2010

7/15/2010 - Walk in FP

7/22/2010 - Online status changed to "Case sent to local office for interview schedule"

7/27/2010 - Received interview letter for 8/23/2010

8/23/2010 - Passed interview, was informed that next oath date is 9/22/2010 and oath letter will come in the mail

9/3/2010 - Received oath letter in the mail for 9/22/2010
