Hi,

my name is Roberto, I'm italian and I'm married to a US citizen who resides in Italy with me now.

We plan to move to the US next year (around June) as I'm going to start a MBA somewhere there.

We'll be applying for a green card for me later this year through direct consular filing, and assuming everything goes fine, I will have my green card.

I know I will receive a conditional green card as we will have been married for a little more than one year at the time of my request, and I have a couple of questions about that:

1. I have to apply for removing conditions 90 days before the expiration of the gc right? But what is the expiration date? DOes the card start when the GC is adjudicated or when I enter the US for the first time?

2. As I'll be studying in the US, it may be well possible that during the time I will have to apply for the removal of conditions I will be outside of the country for 2-3 months for internship or exchange problem. What should I do in that case? Would that be a big issue?

Thanks a lot to everyone that will help me and my wife out!

Roberto and Melanie

well here is what i know your time the gc starts is when you enter the usa so if havent been married for 2 yrs by that time then you will get conditional card then it is 90 before the end of that you have to file to lift conditions

if you do leave the country your gc will expire in a 6 months time you will need to re-enter before that time or you will have to re-file the whole process again good luck someone will correct me if i am wrong. but thats the way i understand it

Hi,

and thanks for the reply! I appreciate it. Anyway, my second question was different: let's say that my gc is expiring in April 2011, and let's say that from January to April 2011 I would be abroad on an exchange program with my university.

In this case, what could I do?

thanks!

Either arrange your priorities and plans to get the lifting of conditions filed within the 90 day window and be available for a biometrics appointment and possibly an interview or risk loosing your permanent residence.
