My fiancee had all the documents and the medical done already and is schedule for a interview on April 2, 2009 at the US embassy in Manila Philippines. My only worry is that the gender in her birth certificate was inputted wrong of a Male instead of Female. In which she didn't discover it until she was applying for a passport. She had already filed the proper procedure or petition in court to correct this and has the letter to prove it. But the procedure to change a sex on a birth certificate in the Philippines is very hard and slow process. The validity of NOA2 is until May 7, 2009 so that's why she is pushing through with the interview. She has a passport and had applied for one by showing her court petition papers. I was wondering if anybody body can comment on this regarding whether she will be denied or will be asked to come back and resubmit the birth certificate. Based on the lawyer who is doing the petition, it is estimated that her birth certificate will be done by the month of June.

Another filipina had the same problem as your fiancee. They did not issue her K3 (she was married to USC) visa but they (US Embassy) gave her time until she brought the final court decision(?) or the corrected new birth certificate....sorry, i don't know which one because i lost contact with her.

The consul might ask her to submit her birth certificate with annotations from NSO. The submission of additional documents at the USEM is up to one year, after submission of such, the visa will be delivered between 2-3 wks.

hope she'll get her bc with annotation soon
