Hi all,

My wife recently received her conditional permanent residence. Can she now sponsor her son (over 21, unmarried) or must she wait until conditions are lifted from her green card?

She can file the I-130 for her child over 21 unmarried now. Please be aware that there is a very long wait for a visa in this category. He/She would be in visa category 2B and the wait is about 9 years from your wife's country.

If she becomes a citizen she can have it up-graded to 1st category and that will cut the wit time to about 7 years from filing.

Thank you both very much! While we are aware of the long wait, we would like to get things moving as soon as possible.

Now I have one more question if you know. When we file the I-130 for the son, will a photocopy of my wifes passport stamp be sufficient as her proof of permanent residence or do they require a photocopy of the actual green card that is suposed to arrive in a couple of weeks?

Here is the info from the instructions from the I-130.

If you are a permanent resident, you must file your petition with a copy of the front and back of your permanent resident card. If you have not yet received your card, submit copies of your passport biographic page and the page showing admission as a permanent resident, or other evidence of permanent resident status issued by USCIS or the former INS.

So a photocopy of the I-551 stamp in her passport or the Greencard will be ok.

Hi

I applied for my over 21 yr old daughter the day I got the I551 stamp in my passport. I photocopied it and sent the application off. My green card arrived a few weeks later. My application was accepted with the photocopy of the stamp. That was in June 2005 and we're still waiting as expected. It's hard waiting but nothing else to do.

Apply as soon as you are able to. Good luck.
