Really confused about CR-1

Hi everyone, i just joined visajourney, theres a looot of helpful stuff on here, ive been reading for a long time, but haven't really been able to find information about my questions... so i thought i'd join and ask and hopefully some of you who have gone through the same experience, can help me out.

First of all I'd like to say that I'm planning on applying for the CR-1 visa for my spouse since she and i have been married for less than 2 years. I'm a US born citizen.

I think I understand the process, which is first I send the i-130 form and the g325a forms for both of us first..my first question is, when sending proofs besides the marriage certificate, what else would i send, pictures, i dont know a story about how i met her etc.? How about the affadavits of proof of marriage by 3rd parties, is that on a normal piece of paper with the require info and signed by the 3rd party?

I've known her since we've been children, i've known her for like 12 years..though the last 3-4 years have been away from each other having a long distance relationship, though i'd fly and see her 3-4 times a year(i've read that i could send a copy of those visas acquired to her country from my passport as proof), and recently we've decided to get married. now 1 month later, i'm in the US, and am hoping to apply for the CR-1 Visa. I couldn't apply back in the country of the marriage, because of the rules that we must both live in the same country for a period of 6 months before applying in a US embassy overseas.. I couldn't stay there because I need to be in the US for my medical interviews (I recently graduated medicine) from overseas.

Anyhow, sorry for boring you with the details but I thought i'd quickly give a background above.. I'm really worried about the I-864 form... I've have absoutely never been employed before, although she is a nurse and has been for about 3 years now.. I have about 15,000 dollars in my bank account that i recently made her in the US when i moved..but its only been a month. I know that i could use assets to make up that I don't have a salary but if my salary is 0, then i would have to have over $54637.5(3 times the 2009 poverty line for spouse) which we do have...I read on the i-864 that the intending immigrants assets can be used..and her assets are in the form of money in her bank account overseas. My question is would it be sufficient to write the amount of money in her bank account on the i-864 form, and mine and add them up and if they were over the 3 x the 125% poverty line would that be good enough. What evidence should i send along with this form? A bank statement for the past 6 months or 12 month for her and for me as well?? Or would it be better if she wired the money to my bank account in the US. I know its best if the account was a joint bank account, but there's no way to do this as she is not in the US, and has to be physically present to open a bank account. Also, it says that she must be able to demonstrate the ability to move the money to the US within 1 year, how would that be possible to prove? What would i get and where would i get it from, a paper from her bank for example?....

A few more questions about the form...again i'm sorry there are so many questions, but you guys are really helpful.. in part 5 item c of form i-864, it says if you are currently married put 1, well what if the person you are sponsoring is your spouse?? Then when you add up the numbers it will equal 3..in the household size, where it should only equal 2.. what would i do in this case?? eg.. how would i fill out this part..

Final 2 questions, in part 6 questions 22 of form i-864. It says unemployed since, well i've never been employed as i just graduated med school, what would i put? and for question 25 about federal income tax return information.. i literally have no clue what to do there, because i've never filed tax, never had to either because i've never had a job..so what do i do, just put the last 3 years and put 0's? for total income??

There have been many people who said they are using assets only or using the intending immigrants assets only for the i-864 on other forums, but no one has come back to report what happened, so makes me worry..i really hope that it would be enough, thanks so much for all your help i hope to get a reply soon!!! :unsure:

I have about 15,000 dollars in my bank account that i recently made her in the US when i moved..but its only been a month.

I just wanted to clarify because it wont let me edit what i wrote, that i meant that i just have 15000 dollar i brought with me when i moved.. the $15,000 dollars are a going away present from parents, to start my life..its not a salary or anything as it may imply the way i wrote it the first time that "made" it when i came to america, i meant that i made a new bank account that has only been open for a month...thanks again for your help.. and i tried calling USCIS, and they were no help at all.. they literally didn't know anything... its like have the form read itself to you... so i really really need your help guys, maybe someone who went through something like this doesnt have to be exactly the same but parts of it.. thanks a lot for your help again hope to hear from you soon!! Oh and 1 more part that i forgot to include, if she did transfer the money to the account in the US, would USCIS be suspiicious?? I mean if a sudden large amount of money appeared in my account.. i would think so, though i understand the money doesnt have to be in the US i just want the safest way and almost best way to approach this.. thanks agian..byebye

Well I may be a little help as i'm in somewhat of a similar situation. For the form I864 you can have sponsors to make up to be above poverty line (in my case my mom and dad). I also have never been employed and I have no money -even in savings - so what I'm going to do is fill it out as best as I can and attach a letter explaining my situation. And about the household-just make sure you only put yourself and wife and anyone in the house as one answer, if that makes sense, and make sure they add up. As for the I130 read the requirements and follow them as simple as that.

Well.. i already know all the information you stated.. but it doesnt really answer my question, i know about the co sponsor..but I'm try to do apply without a co-sponsor using assets only..the part though doesnt make sense about the household size i want it to equal to 2.. as its only 2 but if i add myself plus 1 that i'm married and the person written above it will add up to 3.. so the form doesnt make sense..thanks a lot for your help kenza.. anyone else have any answers for my questions above..

Well, I don't know if you should worry so much about the I-864 now, because you only have to send it in once your I-130 is approved. Am I correct people? I'm sorry I can't help much about it because I'm not the one filling it out.

For the proof of relationship it can be anything that shows you are together: letters, e-mails, plane tickets, photos, receipts of something you mailed her, or she did to you. Anything proving that there is a relationship going on.

Thanks gixbr, i know that i dont mail in the i-864 now but i really wanna be ready as my situation won't change in the next couple of months after the i-130 is approved, as i see usually it takes about 3 months to get approved..please if anyone has any answers to my questions let me know i'd greatly appreciate it :)

srac, I think the best way of you doing this, in case nobody really has a good answer or a similar case, is calling the American consulate in the country where u got married.

Or, I think in every embassy they have an e-mail where you can 'ask the consul'. That would be nice, here in my country they usually answer my e-mails within 5 days. Not so fast, but it helps.

Maybe I'll try that, but usually they just give out general information as i asked them questions before.. i actually went into the embassy but they know nothing they just give you a pack with the same information that is online.. which is why i wanted to see if someone has gone through some of this stuff before and can give me real life answers...again thanks a lot for your help and if anyone has any answers please lets us know, because i know many people on the internet are looking for answers to these questions and can't find help...

you put 1 in persons you are sponsoring (letter a)

and 1 in yourself (already filled in)

and zeros in the rest

and put 2 for the total size (letter h)

srac, try to look for it in the K3 section of the forum, they also have to fill an affidavit support form, but it's the I-134.

I've read a little bit there and I guess everybody has to have a job. I'm sorry to tell you that, but I don't think there is a way of you getting your wife there without you having a job, only based on your assets, but if you get a co-sponsor you should be just fine. The good news tho is that it doesn't have to be for too long. My husband was traveling and didn't have a job, so he got one 3 months ago and we are fine.

hey guys really need an answer..just trying to keep this thread alive..

You arrive at the household size of two by following in the instruction to avoid listing anybody twice. For the purposes of the I-864, do not list the beneficiary in the spouse space, even if they are the spouse.

You'll need a joint sponsor if all you have is $15,000 in cash at the time you execute the affidavit.

Facts are cheap...knowing how to use them is precious...
