:blink: Well here we are all back to take this journey again. We sent in the paperwork on the 28th February. Only mine this time as my daughters GC doesn't expire until July (long story) but they messed up for a bit when we were adjusting status.

With that said, I have a bit of an issue and don't know if anyone has addressed this before.

*big breath* I just found out today, that my daughter is pregnant! She is 16! :crying: And while I have a lot of things to consider, a worrying thought came to mind about her immigration status and if I will still be able to remove conditions on her in a couple of months when it is her time.

Does anyone know how this is going impact on everything? I am in a total quandry at the moment, with so much going on in my head. Oh and other than that, everything has been great!

I don't think it changes her immigration, although others with more knowledge may chime in, I am thinking you must be in shock, take some time, and try to be gentle with yourself, only hoping for the best for you all

Thank you for replying, yes we are all still in a state of shock.

Well, another shocker, I just got an RFE from Vermont. I had a feeling something wasn't right as the check hadn't been cashed. I didn't include my daughter on the I-751 because they messed up, although I did list her in Part 5 as a dependent living with me. My AOS was approved 4/2/2007 and hers was 7/11/2007. In my books that is 101 day or something, anyways it is more than 90 days.

I even stated it in the cover letter I sent! It isn't rocket science. I even had it all written out as to why she wasn't included in my letter.

They sent the whole packet back with a letter that reads, "If you have children listed in Part 5 of our I-751 who became CPR either on the same day as or within 90 days after the CPR in Part 1 (me), the children are eligible to be included in your petition. . ."

The rest of the letter basically turns threatening saying they will remove her from my petition and terminate her status.

I need help! What do I do? If I resend it, this time with the biometrics for her and a copy of her greencard, then I risk going out of status if they send it all back again when they realise their mistake, I have until April 2. I hear you asking why did I wait so long in sending it in? I misread somewhere that we could do it up to six months before and I was going to include her on it to try and save $545 in fees for filing her separate. Then I read it had to be 90 days just before sending it in, so I just sent in mine.

I am over this already, everytime I deal with USCIS there are problems, last time they lost my file for six months, making us do the medical on my daughter again as it went past twelve months from the original medical that was done.

I don't think you did anything wrong. I would get an INFOPASS and call the 800#. Explain to them the situation. You will need to file a separate I-751 for your daughter when the 90 day time period comes. It is too early now.

Get your I-751 submitted without putting your daughter in Section 5. You should submit it NOW or you will lose your GC April 2. USCIS goes by date of receipt not date of mailing.

When the 90 days comes up for your daughter submit another I-751 for your daughter.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

So you think to do another I751 without mentioning her would do the trick? I had already resigned myself to the fact that we had to pay an extra $545 because of their incompetence. We only received it all back today, so we can't call them until Monday and get any answers out of them.
