Do what you think is best for you... we will be here when you get back (if you go). We are almost there... remember... when you reach the end of your rope... tie a knot on the end and hold on tight!

My lawyer says they will not be allowed into America after you get the NOA-2, they will only be allowed in after you get the visa stamp in the passport.

Smarter people than me will have to respond... I do know that the Embassy will cancel your current b1/b2 visa when they approve you for the K1. I don't see why someone would not be allowed to enter (other than the basic normal risks of entry) just because one has a NOA2. I mean, they do allow people in when there is a petition for a K1... so why wouldn't they after a NOA2?

:crying: I was hoping to find numerous approvals from yesterday when I woke up and logged on this morning.

That's okay though... just means a whole bunch today! August 6th on the Catholic liturgical calendar is the Feast of the Transfiguration, so I'm confident that lots of March I-129Fs will be transfigured into NOA2s today!

Improved USCIS Form G-325A (Biographic Information)

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.

I have no idea. That's just what my lawyer said. She said after you get NOA-2 they will give you trouble.

The border agent on arrival could look at it as though the person entering the country has a higher likelihood of not returning since it is clear from the NOA2 that folks are engaged. On the other hand, they could view it as though the couple is following the rules and so will be less likely to jeopardize the K1 application.

So I think it all depends on how it's viewed by the agent at the time of entry. Personally, I tend to look at it like this.......... :girlwerewolf2xn:

I never would have believed my journey to happiness would begin with something called an "I-129F"

03/19/09 - I-129F Sent

03/20/09 - NOA1 (rec'd harcopy 3/26/09)

03/24/09 - Check cleared

03/25/09 - Touched

8/12/09 - Touched (4 hours before NOA2 email)

8/12/09 - NOA2 email received

***Received email at noon (Weds)

***USCIS site did update with the status

***Was 113 on Berkeley list; 156 on VJ list

I asked a very friendly customs agent months ago about it all.... as I heard different things, and he confirmed that you can travel up until you have the actual visa. Obviously it is up to the discretion of the agent each time one crosses that border, but that's what he said. He actually said he once allowed someone through even after she had her visa, but they didn't use it during that crossing. She just wanted to go down for a quick visit to put the final touches on her wedding. I don't think I'd chance that... but anyways, just wanted to share what I was told.

I didn't upload the DS-156 at all. It must be filled out at the link above, as the web form generates a printout with a unique barcode when submitted.

I uploaded the DS-156K, which is the Nonimmigant Fiance Visa Application. The version I posted is the most recent version as downloaded directly from the Department of State. Per the DS-156K instructions, K-1 visa applicants must complete the DS-156 AND the DS-156K: "This form, together with Form DS-156, Nonimmigrant Visa Application, completed in duplicate, constitutes the complete application for a "K" Fiancé(e) Nonimmigrant Visa authorized under Section 222© of the Immigration and Nationality Act."

I also uploaded the DS-230 Immigrant Visa Application, which some consulates require as part of the Packet 3 information. Once again, the version uploaded is the current version from the Department of State website.
