Hi, I have a question. For a misdemeanor (CIMT) committed overseas, does the U.S. embassy abroad use the U.S. Criminal Code for the equivalent offense to establish the maximum sentence possible, or do they just go by the criminal law of the foreign country? The reason why I'm asking is that it could make all the difference in the world for me trying to get the "petty offense exception." That way I would not be inadmissible. Also, the US Code makes it very very clear as to what the maximum sentence is for the equivalent crime, where as the Penal Code of the foreign country does not. Please help me with this issue or send me any links with pertinent information. Thanks in advance.
