First off, hello to everyone here!

The basics: I am an US-born citizen (residing in the US) who intends to marry an Indian-born citizen (who currently resides in India).

Which visa will get her here the fastest? K1, K3, or IR1? I will be visiting her soon, and if needed can get married in India. In either case, I can start the paperwork right away. Ideally, I would love for her to be here by August 2009.

Another quick question: After I start the process for a K1/K3/IR1 visa, can she apply for a visitor/tourist visa? That way she can be here at least for some time while we wait. Because after seeing average of 6-9 months I'm a bit sad.. :crying:

K1 is faster than other visa but if you get married then apply either K3 or IR1. Both approve almost same time.

For K1 you can start paperwork but for K3 and IR1 you need marriage certificate.

I am not sure by Aug. 2009 try if you are lucky. After applying any visa petition, she will not able to come here either visitor/ tourist visa.

K1 route is your best bet. Fastest visa to get her here, just have to get married within 90 days after she is here. I believe its only taking around 4 months for K1 visa. Goodluck.

Thanks for the replies! K3 would be how long (say K1 is 5 months)?

FYI! You have to have been married for 2 years to get a IR-1.

K3 would maybe be a month longer than a K1. Maybe the same!

CR-1 is the BEST! Maybe a month longer but WAY better visa in the long run. Cheaper also.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

My suggestion would be to take a look at the guides above, read over each visa, and then make a decision. No one on here can tell you what visa to use, or which one is faster than the other, as each and every case is different.

I am thinking about the following: Have her apply for a visitor's visa (she is a medical graduate and was intending on doing an observship anyways in the US). Once received, apply for a K1/K3 visa.

This way she can be with me in the US and start preparing for residency.

Will the fact that she has a visitor's visa affect her chances of getting K1/K3?

This is a good route to go.

No - a visitors visa will not prevent getting a K-1/K3 - it might even make your case easier, because she all ready has the visitors visa.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I agree with everyone comments and suggestion but I would like to add one more option that you have which might be quicker DCF. Check out DCF forum to find out more.

K1 will be the fastest considering the rate at which USCIS is working...or us CR1 approval and K3 approval took 8 and 6 months respectively...its more than a year since we got married and my interview is now scheduled on March24. If you are concerned mainly about the time lag K1 is the best bet..

Thanks...Six months for the K3 - that doesn't seem too bad? Is that six months from first filing to visa approval?

No, it is 6 months from petition to approval. If you read her post, the interview is on March 24 and if you look at the timeline saps filed in May. So, assuming she gets approval in March, it will be 10 months from petition to approval.
