Please Help!! Interview questions

Timeline

So good news is that we just got our NOA2 form!!! and now we started researching about the interview-- and we might have run into a problem and this is where you alls help is needed-- Ok When my fiance first arrived before we met he came in to the country on a J1 visa now-- on the plane he was confused and filled both the white and green form out because he wasn't sure which one to fill out-- when he got to the POE they just took the form that was for a travel visa --- BUT in his passport was his J1 to work for this camp-- he came to camp and worked and only found out later that he filled out the wrong form and the camp never resolved it-- he came back again last year on a J1 with no problems and filled out the correct form and also camp and visited on a tourist visa with no problem-- SO will his mistake that he made 2 years ago decide the fate for our approving of the K!??? Please help we're both FREAKING OUT!!! thanks so much

I don't think it will cause an issue.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I think i'm a little confused. If he didn't overstay the date that was posted on his I-94 he's probably ok. If they issued him another visa afterwards he's probably ok.

However, if there was a home residency requirement along with that last J1 Visa he will need a waiver.

I just noticed that the title to this post says Interview Questions.... if you're looking for advice on what he should say about all of this that answer is easy... the truth! If asked about any discrepencies on arrival/departure records, simply explain what happened.

I also think you guys will be fine :thumbs: he got a J1 visa approved for the second time and there were no problems obtaining that one. To my knowledge Camp J1 Visas are not usually subject to the 2 year residency requirement. This will be indicated on your DS2109 Form - good to have a copy of that at interview for proof I reckon. Best o fluck, almost there!!!

Biometrics: September 26th 2009

EAD card production : October 1st 2009

AP Approval: October 1st 2009

EAD card production again! : October 6th 2009

AP received: October 8th 2009

EAD sent Email: October 8th 2009

EAD received: October 10th 2009
