FYI - Biometrics may NOT be required for EAD.

I asked this question before and didn't get a great answer. Here is what I learned today.

A biometrics appointment may not be required for an EAD. As was our case.

Unfortunately, they state the post office lost the EAD card and we would have to resubmit the paperwork with another $430.

In my case, I was asked to do biometrics again. I filed for EAD extension. Just had it taken.

I have a question for you. How many days/months since you filed the extension EAD then you are supposed to receive your card (the one that was lost in the mail)?

Normally, biometrics are needed for an EAD under AOS, because the card has the fingerprint on it. The EAD under OPT has no biometrics, no fingerprint is put on the card, and pictures are sent with the application for EAD anyway. So, I guess they can issue the EAD without a biometrics appointment under AOS (since they have your picture sent in with the application).

I had an EAD under OPT and I had no biometrics scheduled, the card had only the picture I send in when I submitted the application. The card under the AOS has the fingerprint, and the picture taken at the biometrics appointment.

11/17/08 : Application sent (I-130, I-131, I-485, I-765)

11/18/08 : Official receipt of documents stated on I-797C (Signature for receipt at USCIS was on 11/17/2008 at 10PM)

11/28/08 : NOA Received ( I-797C) for all 4 forms (forms issued on 11/26/2008)

12/18/2008: LUD on I-130, I-131, I-765

01/29/2009: Bio done

01/29, 30/2009: LUD on I485 and I765

2/10/2009: issued AP, valid 1 year for multiple entries.

2/23/2009: Got EAD card

3/8/2009: LUD on all applications. Shows approval of I131 and I765, still pending on I130, I485.

04/28/2009 at 9:30 AM: Interview. Told to wait 90 days for a resolution by mail.

05/01/2009: Card production ordered.

05/06/2009: Received approval NOAs for I130 and I485 (welcome notice, 10 years card). I130 still shows case received and pending.

06/18/2009: got the 10 years validity card. Process length: 213 days since sending the applications.

No RFE at all along the process.

OK this is messed up!

I got home today to find a Biometrics Appointment Letter in our mailbox. How strange is that? I got no email notice even though I am signed up for email notifications via uscis.gov for all case numbers (I485, I765 etc). Our biometrics is 3/18/09 and it has both the I485 and I765 listed on the appointment. Soo....

Did the immigration officer lie to me? I asked her to verify the case number I'd given her over the phone when she stated it was approved and sent to us. So, I know she had the correct case number. Why would someone tell me it was approved and sent if they never got the biometrics appointment and it wasn't approved or sent?

I am a little confused, a little happy (if it means that we don't have to resubmit our paperwork and money), and a little angry if she really did lie. I guess we'll wait and see a little. Maybe it'll come, if not I have already sent my senator a letter.

I hope this works out. I'm just frustrated.

Something is screwy here. As mentioned, biometrics is required for an EAD - because your fingerprint (as captured at the biometrics appt) is printed on the right-hand side of the card!

I'd take an Infopass appointment if I were you (just take whatever appointment type you can get if it tells you none are available for EAD issues) and ask a real IO in the flesh to find out what on earth is going on. For some reason, I always feel a lot more comfortable that I've been understood face-to-face rather than speaking to an IO on the mis-information line (assuming you even get past the script readers :lol:).

Looking at your timeline, you should have been given a biometrics appt way back in December/early-January or thereabouts. Most of us only wait a month or so from NOA1 for the appointment to come through...

05/20/08 - POE: Chicago O'Hare

07/18/08 - Married

08/30/08 - I-485/I-765 mailed...

03/17/09 - Card production ordered (no notification received!)

03/26/09 - Green card received (196 days)

Removal of Conditions

02/15/11 - I-751 mailed to VSC...

02/22/11 - NOA1 (received 03/03/11)

04/04/11 - Biometrics appt (notice received 03/19/11)

08/22/11 - * * * t u m b l e w e e d s * * * (T+6 months and counting)

09/20/11 - Service Request #1

10/26/11 - Service Request #2

11/29/11 - Interview @ Atlanta Field Office - Approved & I-551 stamped

12/07/11 - Card production ordered

12/10/11 - Green card received (293 days)
