it happens that my friend was married in american so she found out that her guy got new girl his ex wife they been together again since last yr then the guy told her that his not going to stop the visa because he want the girl in US so he will provide all the doc then this girl met a new guy so theyre plan is to get married when she get there in US as K3 so do u think the girl or guy can file divorced even she just get there bcoz she want to get married in the guy from georgia which his ex hubby is going to married again his ex wife... any help would highly appreciated.. thanks

your post is very confusing. so let me translate to see if i got this right. the petitioner is still having a relationship with his ex-wife but still wants to bring this woman over that he was currently petitioning to the usa while being with his ex wife. The petition gets married to his girlfriend then when possible gets divorced and then go back to his ex wife? is that right?

if so, then that is what you call MARRIAGE FRAUD. The relationship should be a real one not just for papers. This is totally wrong. MARRIAGE should not be violated like that. My suggestion is tell them to break up. I'm assuming the lady being petitioned knows about the arrangement with the ex wife if that is the case she is a piece of trash just like the ex wife and petitioner. IF she is NOT aware of the setup then she should know and get out ASAP find a real man who really loves her and can have a REAL life instead of this joke. have a nice dayh

What you first suggest is marriage fraud.

If the girl found a new USC (convenient that is) to marry, then that USC should petition for her, once she gets a divorce. (since the first marriage is not valid, and I would think that it would be hard to prove it was in "good faith")

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

If I understand this...why doesn't the girl, just get her new man to do the visa for her? The man in Georgia? Why is she trying to come here by the first man that went back to his ex-wife???

If she has a REAL relationship with the man in Georgia then she can marry him and let him file for her.

I will echo what others said, what your friend and her husband want to attempt is visa fraud.

she wants to stay married long enough to get into the us, only to get a divorce and then marry someone else?

a) its fraud

B) her adjustment of status should be based on the marriage that brought her here on the k3, NOT the new guy she met..so that poses another "technical" problem

Hmmm it's like you can do whatever you want and I'll do whatever I want. I will process the K3 visa, to get you here but you can't stop me seeing my ex wife. ANd for the girl, wow that's so fast to find someone to replace the husband? And to her current bf, wow he is pushing her to get a K3 visa and when she arrives in US they will live together, get married...SO if they want to get married, why not her new man help her getting annuled? I think she should learn a lesson from this, marriage is not that easy. Marriage is not a contest, there's nothing to rush. I am not being judgmental but it does often happen that they just met and they got married. With this situation, some fail but some succeed. ANd there she goes again, she just met a new guy and want to marry her? It's so sad that people do this, while some or few people who got real, loving relationship waited so long to be in each other's arms. SO if I were her? Let your marriage get annulled, you can file for annullment and let your new bf pay for the expenses.....It's your choice, since its clear, qualified for visa fraud, its either doing the right thing OR have a bad record?

Whats up lately with all the filipinas trying to explain, in broken English, some scheme that their "friend" is trying to pull???? All these stories are so discouraging and no wonder there are so many REAL couples going through hell to get their lives finally together!!!
