Hello all.

If I apply for a K3 visa, does that automatically appy for the cr-1 visa to as part of the k3 application?

also, is the I-130, IR1/CR1 the same visa or is there a difference between them? If you apply for one are you appling for all of them.

how do you apply for k3 and cr1 at the same time and how do you stop one if the other is approved first.

I am very confused by this.

to file for the k3, you must file a I-130(cr-1 or IR-1 if you have been married longer than 2 years), you then send in the I-129f, this is what makes your petitiona "k3". so you petition for both, but you have the option to apply(at the consulate aftr approval) for the cr1 OR the k3. If you ignore the post approval correspondence for the cr1, you can follow the k3 route. if you follow it through the national visa center, then they send the case to the consulate and schedule a cr1 interview. if the cr1 file reaches the consulate before the k3 interview has taken place, you MUST interview for the cr-1.

the "applying for both at the same time" is after the uscis approves the petition. see above.

First you need to file I-130 forms with require documents. CR1 means conditional resident, if marriage is less than two year old. IR1 means immediate relative of US citizen, category 1, if marriage more than two years old. CR1/ IR1 fall under immigrant visa category.

For non-immigrant visa you have to send I-129F along with NOA1 of your I-130 petition (then fee for I-129F will be waived) with exact replica of documents that you sent before with I-130 form. Time gap between your both petitions are almost three week, if you receive NOA1 and send I-129F ASAP.

Due to short time gap, your both petitions will be approve by USCIS at same time (in most cases) or just few days apart. Then you have choice which route (I-130 for CR1/IR1 or I-129F for K-3) to follow at NVC level. Basically, you just ignore one petition after approval.

Now a days you will have visa under both category almost same time (just 1-2 months difference) and CR1/IR1 cost you less than K-3)

I-129F (K-3):

02/17/2009: I-129F NOA2: Approved in 190 days from NOA1 date

<not pursuing I-129F petition further but NVC forwarded case to Consulate on 02/24/2009>

NVC Journey:

02/19/2009: NVC Received/Case number assigned for I-130

02/20/2009: DS-3032 sent by e-mail and 03/04/2009: DS-3032 sent by regular mail

02/26/2009: NVC received DS-3032 Choice of Agent selection

02/26/2009: DS-3032 accepted and AOS Bill Generated but not IV Bill

02/28/2009: AOS Bill Package received in mail

02/28/2009: Paid AOS Bill and IV Bill (as it was available) online

03/03/2009: Both AOS and IV Bill Show as Paid and Coversheet Printed

03/04/2009: Mailed I-864 and IV (DS-230) Packages

03/06/2009: I-864 and IV Packages Received by NVC and Scanned on 03/10/2009

03/13/2009: Case completed at NVC (in 17 working days from date NVC Received)

03/25/2009: Interview date assigned by NVC

US Consulate @ Mumbai, India

04/02/2009: Medical Exam (based on NVC e-mail for interview)

04/13/2009: Interview Packet Received from US Consulate

04/16/2009: Documents submitted at VFS office

[Classified]: Date of Interview

USA Journey

02/21/2009: Permanent Resident # Received (Ref: NOA2 of USCIS)

05/2009: POE

##/##/2009: Permanent Resident Card

##/##/2009: SSN
