Hey Guys,

Can someone help clear this in my mind?

For the Affidavit of Support, we submitted my wife and her Mom's tax returns for 2007 - the most recent they had as that was in 2008.

Now, on the letter is states: "Federal income tax returns ... for the most recent year". Neither my wife and I or her Mom (so-sponsor) will have filed for 2008 by the time that we have our interview. Will 2007 suffice or will we need to supply the returns for this 2008 and get them filed in the next few days? Given the deadline for returns has not passed I assume we will OK but I'd rather err on the side of caution.

Also, its says if your eligibility is based on marriage ... bring ... custody papers for your children. I have two kids from my previous marriage, they don't live with us and I wouldn't have a clue where to get these but my son is 18 and daughter is 16 and I believe custody orders in the UK ends at 16. Do we really need this evidence?

No one seems to know the Custody papers issue.

For those of you coming over me, in the UK Residency Orders (formerly Custody) expire when a child reaches 16. So not only do I not have these documents but even if I did they would not be valid.

Based on your timeline, there are 9 days until your interview. I don't know how complicated your mother-in-laws taxes are, but you could at least fill out the forms on a free on-line site (TaxAct, etc). That along with the supporting evidence (W-2, 1099s) will be more helpful than pleading its not April 15 yet. Do your joint taxes - you were married as of 12/31/08, right? - and include as well. But the co-sponsor's are more important.

No one knows for sure how YOUR CO will handle the situation - but you want to be cautious and there is still time.
