Hey everyone,

Haven't posted on here in like two months, but anyways I have a question for you guys.

So my wife and I got married within the 90 days, however we have NOT filed for AOS yet.

We plan on doing that in about three months, however I was wondering if it's possible for her to get a work permit while we are waiting to save up money for the AOS.

Also, from what I understand you can get a temporary EAD? Do you have to get this within the 90 days before you're married, or can you get it whenever?

And can we get an EAD (temporary or not) while waiting to file for AOS?

basically, no. after the I-94 expires, have to file for AOS in order to also file for an EAD Card.

If you file I-765 based on K-1, the resulting "TEMP" EAD will expire 90 days after entry, since USCIS can take 90 days to approve the I-765 in most cases the EAD expires BEFORE they can approve it. This is a waste of $340.

K-1 needs to file the I-765 when they file I-485 for AOS, the cost is included with AOS, and this EAD is valid for 1 year, the I-765 is coded (C )(9 ) based on the pending I-485.

Moving this to Work/Travel prior to green-card

Social Security website says you can work with the I-94 card without any other authorization if you are a K-1, but after it expires, then you will need the EAD

This temporary work permit was a stamp generally given at JFK airport and about no where else. This privilege will go away in april. My wife received this and was able to take a "small job" to help her in adjusting and learning English.

You can apply for the EAD before her I-94 expires, it will cost you $340 and I doubt you will get it very fast. If you apply for it with the AOS there is no extra charge, but you will likely get the green card first, so you get what you pay for. The xtra money is probably not worth the benefit. Better to keep the $340 for your AOS fees.

Note: As I said before, if a K-1 files I-765 BEFORE they file the I-485, the resulting EAD will be a temp 90 day EAD that expires the same date as their I-94 card, this is a waste of $340.

Second Note. The K-1 expiration date is the date the visa expires, this is the last date that the Visa can be used to enter the USA, nothing more, this date has nothing to do with EAD or AOS process. The I-94 Expiration date is the date by which a marriage needs to happen, and is the date that temp EAD expires.
