Denied K1 visa, 3 years ban

Reread please what I stated earlier: I WAS NOT DEPORTED EVER.....I left by myself,and never got any notices about this issue.

And 212 9BiI is for my 3 years ban. I did not overstay.My extension was pending,which means I have the right to be in states as long as my case is pending. and yes I have to fill my I-601, just not sure if its worth the trouble....and probably denied at the end too!

I was actually expecting some info from people that had similar situations and could advise us anything about this hardship waiver.

Sweetheart, I am trying to explain to you that you are incorrect in your assumption that you need an I-212, and that the ban you listed is, IN FACT, an overstay ban as is stated in the Immigration and Nationality Act piece of law that you cited.. . . but since you are not willing to read the very important legal information that I have posted for you without freaking out, I will no longer answer your questions.

I am sorry for my attitude earlier...I really didnt mean to offend anyone!

I made some researches these days and also found out that this 212 that i got is more for an overstay, but at the embassy no one said anything about that,just that the main issue was that I worked while waiting for the actual I-94.

and like I said it at the beginning, on the document that I received from the embassy was written :

section 212a9BiI - APPLICANT WAS WORKING ILLEGALLY IN THE USA FROM NOV TILL MARCH WHILE CHANGE OR EXTENSION OF STATUS WAS PENDING.

Tha is it what I got.

Hi, I just want to ask how long did you overstay? Coz we have the same situation,I left voluntarily even before the decision of extension was made. Is it true that it is not considered overstaying if you filed for an extension? How did you answer this question in your DS 156? As for my case, I did not work while my extension was pending.

Take a look at this information according the overstay...you will probably find your answer there.

As far as I am informed it is not considered an overstay if you applied for an extension before your I-94 expired.
