USCIS Processing Times Improve for Form I-130

Timeline

I overstayed ( 200days with a tourist visa). Now I am trying to be back and be with my boyfriend forever.

We are applying for the k1 visa, but once I read this article saying k3 is taking 99 days at California Center ( i know due the waiver it wont be 99 days) but I was just wondering if it would be better if we get married in april ( he will be here with me) and applying for the k3 visa.

I dont care about money, if it is gonna more expensive or if it will be waste of money, if we can be together faster. The airplane tickets, internacional phone calls and sleeping pills are way more expensive than the fees.

As I remember, you were given a 3 year ban. Your issue is not with the USCIS processing times. It is with the approval of the I-601 which will be adjudicated at the consulate.

With USCIS processing times, it looks probably about 6-9 months from start to finish for a normal case. Yours will be denied at the interview and you will file the waiver.

Others will speak up but I think your lag will come at the consulate, and not with USCIS.

Wherever you read 99 days, is REALLY outdated. The processing times for California are here. K3 is not faster than CR-1 anymore . . .filing the I-129F after the I-130 is really at this point just a waste of time. Both forms are listed as 6 months USCIS processing + NVC time. . . .

Fiancee visas are a little bit faster (k1 not k3) because they go through the NVC so much faster. . .a matter of weeks vs. a few months for an immigrant visa based on marriage. . . .the waivers, however are universally slow.

Thank you guys! This is what I was wondering. In my case, once I need the consulate, I was thinking about the k3 bc I checked here http://www.visajourney.com/timeline/stats.php?cfl= and seems like k3 are a little faster.

Is that right???

Deep in my heart I think that my problem is that I would rather to "get married and wait" then "wait to get married". lol

I looked at your data and it says that average days between NOA-1 and NOA-2 is 121 days for K-1 and 137 days for K-3

If you are looking for speed to interview, go for the K-1. You can apply for that NOW and not have to wait to get married.
