We're using Travis' mom as my sponsor because he's not working at the moment. but she earns enough to be over the 125% for four people (herself, Travis, her husband and myself) so she didnt put down any bank balances or property assets or anything as she is already over the line.

Thats good. Lucky. Fingers crossed my fiance is at the right amount. If not Her mother might have to. Can close friends also be sponsors?

yeah, if it's only you and herself that she has to support then the amount isn't much, i think its a little under $19,000 for two people.

There's nothing saying that the sponsor has to be a family member but Dave had an issue with it at his interview and had to get a family member. He posted about it i think a few pages back on this thread :)

That's good but she doesn't need to count your husband in her household unless she claims him on her taxes (because I assume he's older than 18). He might live with her but that isnt what makes someone a household "member" for the I-864.

ohh, really? i read somewhere that your supposed to include your spouse? and that on the I-134 you add them as a partially dependant if they are also working.....i can't remember where i read that though now, lol. either way, she makes enough anyways, lol.

I'm going to explain the long way just to be safe so don't worry if i write something you already know. :)

With the I-864 the USC spouse is always the primary sponsor. Even if they earn no money they must complete the I-864 and include their supporting documents (proof they filed taxes etc). Their "household" size would be themselves and the immigrant and anyone else they support (such as children under 18, whether they live with the USC or not, and anyone they claim as a dependent on their taxes).

If they need a co-sponsor there are basically two choices:

1. The USC can have someone they live with complete an I-864A, which means that the USC spouse AND the household member co-sponsor combine their income. So for instance if the income requirement was $25K and the USC spouse only earns $10K, the co-sponsor needs to earn $15K to meet the $25K limit. In this case the household count would be both sponsors, the immigrant and anyone either of the sponsors supports/claims on their taxes (as I explained above)

2. They can get a co-sponsor, and friend or family member, complete an I-864. In this case the co-sponsor must been the income requirement for their household size (as explained above), plus the immigrant/s. The USC spouse isn't counted. The co-sponsor must meet the income requirement completely alone, their income is not combined with the USC spouse BUT if the co-sponsor has a household member (such as a spouse) they can ask that household member to complete an i-864A so that the co-sponsor can use that income to meet the requirement. In this case there would be 2 I-864's and 1 I-864A.

Hope that makes sense :D But yeah, as you said, doesn't matter either way 'cause she meets it with him included :)

hey guys

Just wanted to check if any you know how long is the police clearance and medical report valid upto for k-1 visa.

thanks heaps

Regards

Sean

Medical is valid for a year and police check is around the same. For some countries the police check is only valid for 6 months, if there's no expiration date it's a year.

Hey Guys :)

My finace is still filling out the I-134 form and having some issues. She is unsure about the sponsur part and has heard mixed infomation regarding the amount that she has to make a year. So Im asking for some help on here.

Firstly do they want funds in the account to see money in there? or do they just look at what she has had and earns from her job....

Also would you recommend a co-sponsor to go with the form?

I wanna make sure we fill it out all correct

Thanks

She has to make just under $19,000/year. I think you only need a co-sponsor if she doesn't make enough. Someone else might be able to help a bit more/know better. If you read a few posts above - they're discussing something similar - read through & see whatcha can find. :) good luck!

Edit: typing error.

She makes over that, but thinks that they would want to see funds in there as well.(which she doesnt have savings) Will the letter from her work & bank letter be sufficient? :help:

If she makes over that she will be fine. they only need to see funds or assets if she doesnt meet the 125% of the poverty line. So if she makes enough she won't need to include her savings which means she won't need a bank letter also :)

What T&M said... :) she wouldn't need a letter from the bank unless requested if she makes over the 125%. If you look through the guide - (believe you're doing K-1) - it says, when she sends a copy of the packet to you, to also send a letter from her employer. So, as long as she'd send that, stating she makes enough, then you shouldn't have any worries.

Many consulates differ in terms of the I-134 which is why country specific answers are best.. no offence intended of course :D.

Australia requires what the I-134 instructions ask for, letter from the bank, and letter from employer. They will accept tax returns but they don't need them. Other consulates will NOT approve without tax returns. Tony and I submitted on the letter from bank and employer and we were approved without question or RFE. My interview was 5-10 minutes. Super simple. Could have helped Tony's former military... I doubt it but he thinks so :P I personally would supply the bank letter (its a letter from the bank stating when the account was opened etc, current balance doesn't matter) and employer letter as a minimum. Have a tax return/transcript if you want, but always provide what the form asks for first, then supplement if you want/need to.

No offense taken. :) -- should've remembered the country specific deal - it tends to be brought up a bit. Lol.
