Well I had my interview today, just got back to the Gold Coast.. man was i nervous.. the lady who interviewed me was training someone while doing my case and im not sure if she was just being extra picky or not.. but apparently it has to be family members who have to be your co sponsor if you need one.. our lawyer told us it could be anyone we know who earns enough, didnt need to be family, and we got through all the stages apart from the interview which sucks #######! now we have to get a letter stating from my partners brother saying he will support me, he doesnt have to do an I-134 or anything apparently, just a letter and have his W2 on it.. and a letter from some employment saying they will employ me when i get my green card would help alot too.. but i havent got any jobs set in stone, ive been told i can have a job if theres one available at the time but cant really ask them to write me a letter :( hopefully my new co sponsor will be enough, he has $53,000 on his W2 but is a multi millionaire.. mmmm we are so shattered and scared it wont be enough! :( we only had to send copies in by email.. does anyone know how long it usually takes once you send in a copy by email to them to get a reply.... cos when i asked a question awhile ago, it took like a week or more to get a reply! I really hope this works! i just dont know what to say or do, we are shattered! :(

That's bizarre.. and wrong... No it doesn't need to be a family member. The I-134 isn't binding, the I-864 is and that's what's done at the AOS stage. If you read the I-864 instructions you'll see there's no mention of family. It can be your friend, neighbour or stranger. Ugh. I would say she was being hard on you because of "training". That's ridiculous.

Also re the job.. you're not legally able to work until you have an EAD or your GC so a letter of employment would be stupid.. esp given you have 90 days to get married, then AOS can take around 3 months to process so even if you were to marry on day 1 and file the same day you still couldn't get a job for at LEAST 2 months :S

**Edit - also what if your fiance didn't have family? You're screwed out of a visa? No I don't think so. That's why the only requirement is that they're a USC or LPR.

p.p.s. You'll be fine I'm sure. Just a training exercise I think which really isn't fair..

yeh i totally agree with everything you said! When she was interviewing me, she was explaining every single little step to the guy and my process was taking so much longer then everyone elses, and i was the first one to be interviewed! Our lawyers said it could be anyone and they were even surprised and said its sydney consulate being picky or maybe just the officer! from what we understood was that it could be anyone we know, as long as they earned a certain amount and was willing to do it for you.. and we got through the USCIS and NVC but we cant get through the interview stage.. what the! i told her when she asked about employment, i said i havent got anything set in concrete, i have been told i can have a job at my friends plumbing workplace if there is one available and if not the owner said he would help me find something.. but they said well a letter would help you alot saying you will be employed at certain wage with so many hours once i get my greencard.. i couldnt ask this of someone i hardly even know! nor my partner knows at all! ahh this is just frustrating.. We sent in an email with a letter from her brother saying he is willing to support me financially if anything comes up while in the US and a copy of his W2 within a couple hours of the interview finishing and got a reply today saying its been put to my file and waiting adjudication by the consular officer! hope its not the same lady! hopefully this wont take much longer! we are just shattered and dont know what else to do..

12/22/11 Received letter for Biometrics

01/04/12 Biometrics in Phoenix

01/31/12 Received email update from USCIS saying that we've been scheduled for an interview

02/03/12 Got an email saying card production had been ordered for my EAD...now just to wait for the card...

02/09/12 Received email saying EAD card has been sent

02/13/12 Received EAD card :D :D :D :D

03/06/12 Interview in Phoenix :).....Approved :D

03/14/12 Received Green card in mail.....

....no more USCIS until December 2013

That is horrible! Sounds like the CO that was doing the training needs to be re-trained herself! I have never heard before that a co-sponsor needs to be a family member (but I'm definitely no expert).

I really hope you can get it all sorted out soon!

29 Apr 2011 - Case entered into the system/Case number assigned; Medical Exam in Sydney

30 Apr 2011 - Police Check Application sent

2 May 2011 - Called NVC and got Invoice ID number

3 May 2011 - Sent DS-3032 email

4 May 2011 - Received email reply from NVC for DS-3032; Received Medical Exam results

5 May 2011 - AOS invoiced and paid

7 May 2011 - AOS package sent; IV invoiced and paid

9 May 2011 - AOS package delivered to NVC according to tracking

20 May 2011 - RFE for missing IV package....still waiting on Police Certificate!

thanks me too.. i think it might have been sorted, abit unsure what to think of this reply, we sent an email this morning asking for an update with our case and we got this

"Thank you for your recent inquiry.

Your fiancées visa is in its final stages of processing before the visa can be issued. Generally, it will take 5 business day days to print your visa and prepare your document package once the required documents are received in our office. Once printed, your immigrant visa will be mailed to you in the Express Post envelope which you submitted with your application. Please use your tracking number of the envelope to track the visa package online via Australia Post at: www.auspost.com.au/track

Think it is what you are hoping it is :) do I remember you saying you didn't leave your passport with them when you went for the interview? If not you'll need to get that to them for the visa sticker to go into also :)

i really hope its what we are waiting for!! we are holding back our excitment just incase they are waiting for something else which i hope not! but thanks guys for the replys aye! nah the lady at the counter asked me if i wanted my passport back or need it for anything and i said no so yeh wont have to send anything else in :) hopefully next week i get it sometime and ill be flying out a week or so later :) cant wait!! :dance:

Oooo I have a question too... The SS-5 form says in the instructions for the question about your reason for needing a ss number that if you mark the box "non-immigrant, not allowed to work" that I need to provide proof that I need a number. Will my k1 visa and I-94 be enough for them?

You are a non-immigration allowed to work. Yep your K1 and i-94 is all you need (as long a you have more than 2 week left on your i-94)
