Timeline

So I have a question :D What exactly am I currently "classed" as status wise.

I entered on the K1 on 29 October, married Ted within the 90 days and am sending off our AOS papers this week. I know I'm not a permanent resident as I dont have a green card yet so what exactly am I classed as?

Well, once your I-94 expires you're out-of-status. Some people will tell you you're "AOS pending" which is true, but it's not actually classed as a legal status so you're legally recognised status is "out-of-status".

Basically if you're approached by ICE one of two things will happen:

1. They will know that by filing AOS you're "protected" until you get a result and they'll let you go

2. They won't know (or don't care) that AOS makes you "protected" so they will lock you up in detention until you see an immigration judge who will then dismiss the case because you're AOS pending.

Basically you're safe from deportation because immigration judges know the rules, but you still run the risk of ICE locking you up, the fees associated with that, and lawyers fees etc. So the rule of thumb is stay away from borders, public transport like buses interstate (someone got caught there) and keep your nose clean and you should be fine till your GC arrives.

Thanks Vanessa - I wasnt too bothered by the immigration side of things. My question related more to the fact I've been added to Ted's medical insurance despite the fact I have no social security number yet. An unexpected turn of events means that I'll be needing to make use of the insurance but I wanted to see if there was going to be the possibility they could deny the coverage based on my status or lack thereof...

I'm thinking about handing out my resume at some stores at the local mall which I've never done before. Those that have, do you include a cover letter or did you just hand them your resume?

I dress up nice, ask to speak to a manager, and directly hand it to them with a firm handshake. Works rather well, actually.

Oh, and I use a paper that's not white. Makes the resume stand out a little! Though, I wouldn't recommend spraying it with perfume... (And no, I haven't tried that!) :)

Happy New Year!! I hope 2011 is a great year for everyone! My husband and I were reflecting on 2010 and what an amazing year it was. We have some exciting plans for 2011.....one thing is we are moving to Japan!! Woot woot!!

My new years resolution is to find a job :lol:

Thanks Astrid. The application where they asked for the SSN was an online application for a temp agency. I have no problem giving them my SSN at the interview stage but I didn't think it was appropriate when applying online....there's a possibility they won't even call for an interview. When applying for government jobs you have to give your SSN, which I can understand.

I didn't include a cover letter, I just gave out my resume, and whenever I handed one out I asked to speak to a manager and gave them my "talk" about who I was and what I was about :)

Thanks KiwiBird and Astrid. That's the way I thought I should do it.

KiwiBird, I definitely won't be spraying it with perfume. Lol. It reminds me of that movie Legally Blonde when she submitted in her essay on strawberry scented paper :lol: I like the idea of printing the resume on coloured paper but all the articles I've read online or resume writing websites they say to put it on white paper and don't use any fancy fonts or colours.....boring!! I like things to look pretty.

Well it depends on their paperwork but if you're paying for insurance and you were added successfully then I'm sure you're fine.. otherwise why would they add you?

When I was added to Tony I only needed to prove we lived together and were married (they also asked for my SSN) then I had no issues. There wasn't a single qn about my legal status.

He told them at the time I didnt have one yet and they said fine just let us know when she does. We rang them last night and they said there was no stand down period or anything, that I was covered from the day I was added to the policy so am a very happy camper right now :)

Especially since, my big news, I was told I would never be able to have a child. Well Im pregnant, at the age of 40!!!! Now who would have thunk it!! Happy jiggy dance :D

A belated Merry Christmas and Happy New Year to all.

I have been swamped over the last month sampling the US Medical system and I am still sampling it while they work out the issues. I have to say the medical system here works really well and after being in hospital for a few days I was terrified for the bill...the insurance statement arrived....$39K for 4 days....we only have to pay $250 of the entire amount. So I am pretty happy with that.

I know! I was mortified when I saw it. The entire time I was in there and they kept doing tests and meds etc all I could think was 'How much is this costing?' We are lucky our insurance is so darn great through Eric's work otherwise I would be crying.
