anyone know if I can use my photographer side business as income...its not taxable and dont know how to make it taxable...but its an extra 300 to 400 a month which puts me over for the k3 issue for money requirements

Hey Miss Natalie, I saw that you had your bloodwork and xrays done prior to your medical, this was allowed by your panel doctor? which state do you live in, because if you are in QLD then I want to know if I can do that, because it made it cheaper, right? Can you tell me more about what you did when you got your chest xray and bloods done? Were you referred by your GP? And what did you ask for your blood to be tested for?

I am in Adelaide, so not sure about the procedure for QLD, but call your physician and ask. The doctor here prefers it all to be done in advance. WHen I contacted the doctor's office here, the receptionist basically took over. She sent me a list of directions I had to follow prior to the medical, which included where to get the bloodtests done, where to go for the xray and also who to use for the immunisations. I assume I could have used other places for the bloods and immunisations but seeing as the recommended ones probably understand the visa requirements better than just any doctor's office, I decided to play it safe. Each place sent my results directly back to the panel physician so he had them all ready when I got there for the appointment.

It didn't make it any cheaper...just made the costs spread out over a week or two, which can help out :) Pity we can't claim any of it on medicare.

The receptionist gave me a referral for both the bloods and xray, explaining to each office what needed to be tested. The bloods was basically having some blood taken, analysed and the results sent back to the doctor. The receptionist then contacted me to let me know which immunisations I required (in my case, tetnus/diptheria), which I got done a few days later.

The xray was just a quick chest Xray to check for TB and any abnormalities. Took about 5 mins, plus some wait time. And cost $102. The results were sent back to my physician. I was told you do not have to include the actual xray in the packet 3, just the results, BUT we will need the Xrays further down the track so don't lose them and bring them to the USA.

Oh and to let you know, I started all this before I got the NOA2 but it came during the process so I was able to include the case number afterall, though I am not sure it really matters.

I have been looking into this a lot and pouring over it ever since you posted the question. From what I understand, if you make under a certain amount of money in your own small business, you are extempt from filing taxes only if you made less than a certain amount. However, you are technically still supposed to report your business an obtain a federal ID for it to be considered a business.

On the I-134, it states that if you are self-employed you need:

1. A copy of your tax returns

2. Report of Commercial Rating Concern

3. List containing serial numbers and denominations of bonds and name of record owner(s)

I found out in this thread http://www.visajourney.com/forums/index.php?showtopic=81424 that a commercial rating is a Dun & Bradstreet number. I am not sure you can claim this money as valid "income" if you are not paying taxes on it because you have to prove that it is actual income and not an "under the table job"

Essentially.. the IRS insists you report all income so they can take their cut (greedy bastards) Now I am not saying my advice is gospel or anything, but I couldn't find anything else on claiming money as income without meeting these requirements and if you do go to all the extent to make you business "officially legal" you may have to pay taxes on it and that would suck especially if it's not a lot of money.

Personally my ending conclusion is that it's just easier to find a sponsor lol

But, it's your call. I am sorry I couldn't be of further help.

Quick question.... I know we send the DS-230 part I ASAP... do i send part II with it even though it wouldn't be filled out or signed? Also do i send anything with that, or just slip it in an envelope addressed to the consulate?

I contacted the consulate about this form. Apparently Sydney doesn't need it at all for K1 visas. So you don't have to send it with part 1. I have filled it out already but am keeping it in my records just in case :)

I did my medical last week, only did one vaccine (ADT), xray and immunity test. I came in for the results today. That's one major stress gone now as I passed it. When collecting the results I had a shot for Rubella, yes you heard right...even though I had it as a baby and my mother got it, I'm still not immune - so that has the doc surprised, which was a feat in itself. Kari's documents is on the way here, then hopefully if the AFP has actually done anything with my prints and application, should get police clearance back next week. They have a habit of calls being dropped once you try the magic number for the application inquiries. I'm sure if we ring about Osama sightings, that's more likely to be answered than a call about Police Clearances :whistle: I have to be careful with all the forms as I have not yet filled them, though did the DS 230 asap. Those will be done before the Fedex pack arrives with our I-134 and then ready to send off for Packet 4 :yes:

Packet 3 says .... The visa applicant should complete and return form DS-230 (Part I only) as soon as possible to the U.S. Consulate General, Sydney. We only accept original forms, not faxed or scanned copies.

We just got our packet 3 too!

We may have a slight problem tho.........Neil's put in for his last day of work as July 2, 2010 as he's effectively retiring.

On the packet 3 email it says that you "must be interviewed and have your visa issued within the four-month validity of your petition." Our NOA2 says it's good thru Jan 23 but I think this is going to be cutting things too close. How flexible are they on this? Should I just go ahead and apply for an extension?

I leave for an extended trip to see him in 12 days (YAY!) but that means that I won't be able to start gathering the supporting documentation for the affidavid of support (I am the USC)!!

the CR1 packet 3 says

I guess K-1 is different then, whoops!

How close to Sydney do you live? We used to live in Brisbane and my trip down for the interview was done in a couple of hours. I caught the earliest flight down and was on the noon flight back. Surely Neil's employer can allow a bit of flexibility

I just rang today for mine at the brisbane one and it looks like you have to do it at clinic and can not take your own results in.

That's no biggie because if you know what vaccines you require (the document is on the CDC website) just have your GP administer them and bring the vaccination records along. My vaccines were up to date (though the panel doc did give me a MMR booster but that was covered under medicare) so I did not require a titre test
