My wife was a visitor in the US for 8 months from December 2006 to August 2007. That is when I met her. She stayed for 5 months, filed an extension to stay, and was denied and left 28 days later (before the 30 days they gave her to leave).

In the G-325A it asks for

Applicants Residence the last 5 years.

1) Should we put her long term stay in the USA asa visitor in here? Or no, because she was just a visitor?

2) Also, I have the same thing for me... I went to the Czech republic to visit her for 4 months as a visitor, and stayed with her from September 2007 to January 2008. Should I include that in my G-325A.

3) Lastly, I went to the czech republic recently on a student visa for 7 months from September 2008 until February 2009, should I put that one in there for myself?

As a second question, on the DS-230 ( I think we will have to fill that out later )... it asks for all the places you lived since you were 16. In that case, would she have to put the Seattle WA visit since she was there for 8 months, even though she was a visitor?

These dates are basis of proving your relationship with your spouse so it is important to write these dates on G-325A form for both of you as applicable.

e.g., on G-325A, I wrote my visits (5-times after marriage) to India even it was just for 2-3 weeks as allowed by my vacation.

Also mention on DS-230 (completed by beneficiary) staying period. You will not have to submit passport/ police clearance certificate from USA but from your country embassy/ consulate. As far, I know Embassy/ Consulate do it based on a passport check.

What about her visit in the USA, even though she lived with her aunt (and not with me). Could it come back to bite us if we put it in there under residence if she was only a long-term visitor in the US? Will they question that?

Its hard to know if they are talking about "permenant residence", or "any placed you stayed / lived"
